Why is Hanoi slow to revoke the badges of violating transport business vehicles?

Regarding the above content, in an exchange with Giao thong Newspaper, Mr. Nguyen Tuyen - Head of Transport Management Department, Hanoi Department of Transport said that on average, each month, about 700 - 800 transport business vehicles have their badges and signs revoked by the Department due to speeding violations.

The reason the competent authority issues the decision to revoke late is because it must follow the correct procedure. When a violation is discovered, the competent authority sends a notice to the enterprise, waits for the enterprise to explain, and then issues the regulation.

Mr. Tuyen further explained that the road sign system in many places has changed, especially regarding speed. Therefore, in order to avoid handling the wrong vehicle, the Department of Transport often gives businesses time to respond.

Explaining why violations by transport drivers are slow to be warned, the Head of the Transport Management Department of the Hanoi Department of Transport said that warnings immediately upon detecting signs of violations by drivers is the main responsibility of the safety department at each enterprise. However, in reality, not all enterprises do this well. In the past year, the Department's inspection team has also handled many violating units.

In the list of speeding vehicles whose badges and plates were revoked in December 2023 by the Hanoi Department of Transport, there is a tractor trailer of the Bong Sen Trading and Service Cooperative that violated the speed limit 1,063 times in 1 month.

In this list, there are also 4 vehicles violating speed 800 times or more within 1 month such as: Truong Hai Transport Service Cooperative has 2 trucks violating speed 976 and 901 times respectively; Inter Bus Line JSC's contract vehicle violated speed 845 times; Dai Nam Vehicle Transport Service Cooperative's container truck violated speed 842 times.

The Hanoi Department of Transport said that the vehicles that were revoked were those that had 5 speeding violations per 1,000km of vehicle travel in 1 month (not including speeding violations of 5km/h or less) according to the provisions of Decree No. 10/2020 of the Government regulating business and business conditions for automobile transportation.

According to regulations, vehicles that violate regulations will have to return their badges and signs to the Hanoi Department of Transport. Transport businesses are not allowed to use the above vehicles to participate in transport business activities during the time the vehicle's badges and signs are revoked.

Previously, statistics from the Hanoi Department of Transport also showed that, through monitoring, there are still a number of transport businesses in the city that have not seriously and fully implemented regulations on traffic safety procedures.

Notably, in 2023, the Hanoi Department of Transport issued 10 documents to rectify and revoke badges and signs of transport businesses according to regulations. However, only a number of transport businesses complied with the revocation and surrender of badges and signs of vehicles that had been disciplined for violations to the Hanoi Department of Transport, while a number of transport businesses have not complied with the revocation and surrender of badges and signs according to regulations.

Typically, in April 2023, tractor-trailer with license plate 37H-040.56 violated speed 1,551 times, tractor-trailer with license plate 37H-040.55 violated speed 1,118 times (both owned by Truong Hai Auto Cooperative) were handled for violations but to date, the badge has not been revoked or returned.

Dai Lam Transport Cooperative had vehicles violating 7,216 times, Dai Nam Vehicle Transport Service Cooperative 7,182 times, Do Thanh Vehicle Transport Cooperative 5,797 times, Hong Ha Vehicle Transport Cooperative 3,906 times, Thien Truong Service Cooperative 2,197 times in July but have not yet revoked and returned the badge...

To continue to strengthen the implementation of urgent measures and solutions to ensure traffic safety and the lives of people using transportation services, the Hanoi Department of Transport requests the Police and Departments of Transport of provinces and cities to coordinate and direct functional forces to strengthen the handling of violations.

The Hanoi Department of Transport Inspectorate is assigned to preside over and coordinate with the Transport Management Department to inspect and strictly punish violations by transport business units for not complying with the decision to revoke badges and signs of vehicles violating speed limits, violating drivers' working hours, and not transmitting data from the Hanoi Department of Transport's journey monitoring device.

The Department of Transport's Transport Management Department is temporarily assigned to not issue new or reissue badges and signs for transport business units that violate regulations on having their badges and signs revoked without complying with the decision to revoke their badges and signs.
