From November 14 to 16, in Ninh Binh, the Ministry of Natural Resources and Environment (MONRE) coordinated with the Ministry of Justice to organize a conference to establish a program for developing legal documents in 2025 and monitor the implementation of laws by the Ministry of Natural Resources and Environment.
Focus on professional guidance and expertise in legal work
Speaking at the opening of the Conference, Mr. Phan Tuan Hung, Director of the Department of Legal Affairs ( Ministry of Natural Resources and Environment ) said that, implementing the 2024 Work Program, the Department of Legal Affairs (Ministry of Natural Resources and Environment) is the focal point coordinating with the Ministry of Justice and units under the Ministry of Natural Resources and Environment to organize the Conference on the Program for drafting legal documents in 2025 and monitoring the implementation of laws of the Ministry of Natural Resources and Environment. The conference aims to exchange, train, and provide professional and technical guidance on a number of legal tasks for civil servants and public employees of units under the Ministry.
During the Conference, more than 80 delegates will be trained and guided in professional skills and techniques in drafting and promulgating legal documents; controlling administrative procedures and integrating gender equality in draft legal documents; reviewing, checking, processing and systematizing legal documents; monitoring law enforcement and international cooperation on law... At the same time, delegates will directly discuss and ask and answer questions about difficulties in the process of performing professional skills and techniques related to the legal work of the Ministry.
Program for drafting legal documents in 2025
Sharing at the Conference, Ms. Ha Thu Trang, Deputy Director of the Department of Legal Affairs (Ministry of Natural Resources and Environment) said that up to now, units under the Ministry of Natural Resources and Environment have proposed to include 41 documents in the Program for developing legal documents in 2025. These include the Decree detailing a number of articles of the Law on Geology and Minerals on mineral activities; the Decree detailing a number of articles of the Law on Geology and Minerals on basic geological surveys and geological surveys of minerals; the Decree regulating administrative sanctions for violations in the field of geology and minerals; the Decree detailing a number of articles of the Law on Environmental Protection on the responsibility for recycling products, packaging and handling responsibilities of manufacturers and importers; the Decree amending and supplementing Decree No. 03/2019/ND-CP of the Government on remote sensing activities; the Circular regulating criteria for monitoring and evaluating land management and use; Circular providing guidance on assessing the carrying capacity of surface water environment for rivers and lakes; Circular promulgating economic and technical norms for geological investigation and assessment of areas with toxic minerals; Circular promulgating economic and technical norms for mapping current status, risk zoning maps, and risk zoning due to landslides and flash floods at a scale of 1:10,000 and larger; Circular regulating techniques for assessing the quality of surface meteorological documents; Circular regulating techniques for operating infrastructure works to collect remote sensing data, etc.
According to the proposal of the units, most of the documents will be submitted for appraisal in the fourth quarter of 2025, therefore, Deputy Director Ha Thu Trang requested the units to review, focus on speeding up the appraisal progress as well as ensuring the quality of the documents.
Regarding the draft Regulations on legal work of the Ministry, Deputy Director Ha Thu Trang said that at the beginning of 2024, the Minister of Natural Resources and Environment signed Decision No. 246/QD-BTNMT promulgating the Regulations on legal work of the Ministry. The Regulations clearly and transparently stipulate the order, procedures, contents, and responsibilities of units in legal work; The Regulations have made an important contribution to enhancing the effectiveness and efficiency of the legal work of the Ministry. However, the implementation of the Regulations has encountered a number of difficulties and problems that need to be revised and supplemented.
Therefore, the amendment and supplementation of a number of articles of the Regulation aims to innovate, simplify procedures and speed up the progress of law-making; at the same time, overcome some difficulties and shortcomings in practice and update some changes in legal regulations.
Based on the synthesis of proposed opinions from units under the Ministry, the Legal Affairs Department has completed the draft Regulations on legal work of the Ministry, including a number of main contents such as: Innovating and amending regulations on establishing and adjusting the Program for developing legal documents in the direction of integrating and integrating the annual Program for developing legal documents of the Ministry into the annual Work Program of the Ministry; Amending regulations on appraisal of draft Circulars stipulating standards, technical regulations, economic and technical norms in the direction of professional appraisal and legal appraisal being carried out simultaneously, at the same time, revising and clarifying the appraisal process of each type of circular;
Supplementing regulations on assigning units to preside over and coordinate with ministries and branches to draft legal documents under the authority of the Government and Prime Minister; Updating and citing some contents according to the provisions of newly issued legal documents...
Law enforcement monitoring
According to Dr. Nguyen Thi Minh Phuong, Deputy Director of the Department of Administrative Violations Handling and Law Enforcement Monitoring (Ministry of Justice), monitoring the implementation of the law is one of the important and indispensable activities in the process of agencies in the state apparatus performing their functions, tasks and powers to ensure effective implementation of the use of law for state management and social management.
Through law enforcement monitoring activities, state agencies organize and implement law enforcement monitoring activities in accordance with their functions and tasks, and at the same time closely coordinate with relevant agencies to fully and effectively implement their own law enforcement monitoring activities in particular and law enforcement monitoring activities in general.
The purpose of monitoring law enforcement is to review and evaluate the current state of law enforcement, recommend solutions to improve the effectiveness of law enforcement and perfect the legal system.
In line with those objectives, Dr. Nguyen Thi Minh Phuong focused on training and instructing delegates attending the Conference on important contents on the system of current legal documents on monitoring the implementation of the law; Contents and activities of monitoring the implementation of the law; Responsibilities of state agencies in monitoring the implementation of the law and coordinating and mobilizing the participation of organizations and individuals in this activity.
In particular, current laws stipulate quite detailed contents on monitoring the implementation of laws, specifically, Ministries, ministerial-level agencies, government agencies, and People's Committees at all levels monitor the implementation of laws on the basis of reviewing and evaluating three contents such as: The situation of promulgating documents detailing the implementation of legal documents; The situation of ensuring conditions for law implementation; The situation of law compliance.
Regarding the mobilization of organizations and individuals to participate in law enforcement monitoring activities, Dr. Nguyen Thi Minh Phuong emphasized that individuals who are experts and scientists mobilized to participate in law enforcement monitoring activities under the collaborator mechanism must meet the prescribed standards.
State agencies that monitor the implementation of the law can mobilize the participation of collaborators in activities such as: Building survey forms, processing investigation and survey results, synthesizing, analyzing, building reports on investigation results, surveying the implementation of the law and other activities related to investigation and survey; Collecting information, reviewing and comparing the accuracy and appropriateness of information; Providing comments and assessments on information processing; Building reports on information processing results. The report must provide objective and accurate comments and assessments on the implementation of the law and make appropriate recommendations for the collected information.
