Ministry of Construction requests to rectify chaos in submitting documents for buying and selling social housing

The Ministry of Construction assessed that the demand for buying and renting social housing in many localities has increased sharply; people are particularly interested in projects that are open for sale and announced to receive applications. However, recently, at some social housing projects, there have been cases of crowds gathering, jostling, and fighting for space in line.

At many projects, people queue up overnight, make their own lists of numbers, and reserve spots, potentially posing a risk of disputes that disrupt security and order; give rise to illegal brokers, "file brokers", and collect deposits outside of regulations, causing frustration and affecting the image and effectiveness of social housing policies.

Therefore, the Ministry of Construction has just issued Official Dispatch No. 13732/BXD-QLN to the People's Committees of provinces and centrally-run cities requesting to rectify the work of receiving applications for purchasing and leasing social housing.

Because of the above situation, if not promptly corrected, it will not only cause disorder and insecurity but also potentially create negative risks, creating a favorable environment for all kinds of "brokers" and intermediaries to receive money to "take care of documents", advertise " diplomatic quotas"... in violation of regulations, distorting policies, affecting people's trust and causing difficulties for state management at the local level - the Ministry of Construction emphasized.

Accordingly, the Ministry of Construction requested localities to implement many solutions to ensure that the receipt of social housing purchase and lease-purchase applications takes place in an orderly, transparent, convenient and legal manner. In particular, the Department of Construction and relevant agencies need to focus on urging social housing projects in the area to speed up progress and put the projects into operation soon.

Information must be made public for all projects being implemented in the area, at least 30 days before receiving documents. The public content includes information: project scale, number of apartments, selling price, rental price, time and place of issuing documents; start and end time of receiving documents...

Publicity must be carried out simultaneously on the website of the Department of Construction, the People's Committee of the commune where the project is located and at least once in the newspaper which is the mouthpiece of the local government.

At the same time, the Department of Construction and relevant agencies are responsible for guiding people to prepare documents and papers proving their eligibility and conditions, avoiding having to supplement and travel many times; directing agencies and units with people registering to buy social housing or competent local authorities to confirm eligibility, income conditions, and housing conditions for subjects according to the form of Circular No. 32/2025/TT-BXD dated November 10, 2025 of the Minister of Construction amending and supplementing a number of articles of Circular No. 05/2024/TT-BXD detailing a number of articles of the Housing Law.

At the same time, localities directed local police to coordinate with the People's Committees of communes where the project is located and investors to develop plans to ensure security and order, traffic flow, and avoid crowds and jostling.

The list of people eligible to buy or lease social housing after signing the contract must be made public and updated on the Department of Construction's Electronic Information Page to serve post-inspection work, avoiding duplication of subjects.

The authorities will inspect and handle illegal brokerage, “baiting”, collecting deposit fees, collecting “guarantee application success” fees, and selling “diplomatic quotas” against regulations. Publicly announce violating organizations and individuals to warn the public.

For investors of social housing projects, the Ministry of Construction requires strict implementation of procedures for buying and selling social housing according to the provisions of law.

Along with informing and communicating about social housing policies in the area so that people can understand the policies and avoid being deceived, localities need to strengthen post-inspection and handle violations such as: regularly checking the status of management and use of social housing; strictly handling and recovering apartments in cases of false declaration, illegal transfer or wrongful transfer.

For social housing project investors, the Ministry of Construction requires strict implementation of the procedures for buying and selling social housing according to the provisions of law. Publicly announce information of social housing projects on their business information pages, and at the same time send project information to the Department of Construction and the People's Committee of the commune where the project is located for announcement and posting on other official local information channels according to regulations.

In case of direct application submission, the investor is required to arrange multiple reception points; divided by time frame, day, or by residential area, with guidance signs, and support forces to regulate and divide the flow to avoid concentration at one time.

Investors must have a backup plan when the number of applicants exceeds the capacity. In case it is necessary to extend the time for receiving applications, promptly announce publicly at the locations for receiving applications, mass media and report to the competent authority to ensure that all applicants are received.

In addition, encourage the application of digital technology : receiving applications online, queuing electronically, distributing applications online to reduce the number of people coming in person.

For social housing buyers, the Ministry of Construction recommends proactively learning about legal regulations to avoid being taken advantage of and profiteering; proactively finding information about social housing in the area at official channels such as: Electronic Information Page of the Department of Construction, People's Committee of the commune where the project is located, newspapers that are the mouthpiece of local authorities, and the official information page of the Investor.

Home buyers only work directly, following the instructions of the investor's staff; do not buy or sell through "brokers", intermediaries or trust in "diplomatic quotas", "internal quotas"; follow the instructions of staff or security forces at the application submission point, do not jostle or push; declare and take responsibility for the honesty of the registration documents; only submit documents at one project, do not ask someone else to stand in the name of the application.

The Ministry of Construction requests that the People's Committees of provinces and centrally-run cities pay attention to directing and seriously implementing to ensure that social housing policies are implemented according to their objectives and to improve the effectiveness of state management.
