The Ministry of Finance has just issued Circular No. 91/2025/TT-BTC dated September 26, 2025, stipulating a system of forms for the settlement of projects using public investment capital. The issuance of this Circular aims to synchronously and effectively implement the provisions of the State Budget Law, the Public Investment Law and especially Decree No. 254/2025/ND-CP dated September 26, 2025 of the Government on management, payment and settlement of projects using public investment capital.
Circular No. 91/2025/TT-BTC was issued in a timely manner, meeting the requirements of updating new regulations, ensuring unified implementation from the central to local levels. Thereby, the Circular contributes to improving the management efficiency of state agencies, supporting investors, saving time and costs in the work of synthesizing, reporting and finalizing, and improving the efficiency of using public investment capital.

Compared with previous regulations in Circular No. 96/2021/TT-BTC and Circular No. 63/2025/TT-BTC, the newly issued Circular has many important new points.
Regarding the approval authority, since the current State Budget Law only stipulates that the superior budget unit directly reviews and issues a notice of final settlement approval (no longer requiring the financial agency to issue an appraisal notice), the new Circular has removed the appraisal form of the financial agency, added a form of approval notice of the superior budget agency and a form of final settlement inspection document of the financial agency to implement uniformly nationwide.
Regarding forms, the Circular clearly stipulates and streamlines the form system, suitable for the two-level government organization model, while maximally simplifying administrative procedures.
Regarding the database, the Form System is designed to be interconnected, clear, convenient for computerization and centralized management, and provides good support for reporting and monitoring.
In addition, the Circular stipulates 5 forms for annual financial statements (4 forms less than before) and 12 forms for completed project financial statements (3 forms less and 1 appendix less). This reduction helps reduce the procedural burden for units while still meeting management requirements.
Circular No. 91/2025/TT-BTC takes effect from September 26, 2025, the same day as Decree No. 254/2025/ND-CP, replacing Circular No. 96/2021/TT-BTC and Circular No. 63/2025/TT-BTC.
The synchronous issuance of the new Decree and Circular will contribute to improving the efficiency of management and use of public investment capital, promoting administrative reform and increasing transparency in settlement work.
The Decree clearly stipulates the payment process, annual settlement, settlement of completed projects, projects with capital contributions in kind or ODA capital and preferential loans. Management must ensure the right purpose, savings, transparency, and not exceed the total investment or approved capital plan.
The State Treasury is the main agency implementing disbursement; for secret defense and security projects, the Ministry of National Defense and the Ministry of Public Security are authorized agencies to control and pay.
