Protect the legal and legitimate rights of Vietnamese workers at foreign agencies and organizations

On June 20, the Diplomatic Corps Service Department coordinated with the Social Insurance of Region I to organize a seminar on "Social insurance policy for Vietnamese employees at foreign agencies and organizations".

The seminar was attended by Mr. Ngo Phuong Nghi, Director of the Department of Diplomatic Corps Services; Mr. Nguyen Cong Dinh, Deputy Director of Social Insurance Region I; representatives of diplomatic missions, consulates, international organizations and foreign offices in Hanoi and more than 200 Vietnamese employees working at international agencies and organizations.

In his opening speech, Director of the Diplomatic Corps Services Department Ngo Phuong Nghi emphasized that along with the country's international integration process, the diverse and internationalized working environment is increasingly expanding, creating conditions for thousands of Vietnamese workers to promote their role as a bridge of friendship, contributing to promoting the image of a friendly, integrated and developed Vietnam. According to statistics, there are currently nearly 5,500 Vietnamese workers working at foreign agencies and organizations in Hanoi.

This is a special workforce, regularly exposed to the international environment, playing an active supporting role in the activities of foreign representative agencies in Vietnam. However, they are also facing many difficulties in accessing and enjoying social insurance policies, due to differences in mechanisms, policies as well as understanding and application of the law.

Faced with that reality, the Department of Diplomatic Corps Services has proactively coordinated with the Social Insurance Agency to organize consulting activities and support Vietnamese workers in foreign agencies and organizations. “The cooperative relationship between the Department and the Social Insurance Agency of Region I is not simply professional coordination but has become a real companionship, aiming at the common goal of protecting the legitimate and legal rights of workers,” Mr. Ngo Phuong Nghi affirmed.

At the seminar, Ms. Duong Thi Minh Chau, Head of Social Insurance Communications Department Region I, introduced the basic new points of the Social Insurance Law No. 41/2024/QH15 and the Health Insurance Law No. 51/2024/QH15, effective from 2025.

One of the highlights is the construction of a more flexible and multi-layered social insurance system, allowing workers to have more options suitable to different conditions and circumstances. In particular, the new Law expands the coverage of compulsory social insurance participants, including unpaid business managers, part-time workers, new forms of labor contracts, and even regular militia.

For foreign employees working in Vietnam, the Law also clearly stipulates the subjects participating in compulsory social insurance when signing a contract of 12 months or more with an employer in Vietnam. However, there are three exempted groups including: people moving within the enterprise, people who have reached retirement age and cases stipulated in international treaties to which Vietnam is a member.

The new law also clearly stipulates the policy of linking social insurance and social benefits, ensuring that no one is left behind. Workers who reach retirement age but are not eligible for a pension can choose to receive a monthly allowance (at least equal to the social pension level), while also enjoying health insurance guaranteed by the state budget. If they meet the conditions, their relatives will also receive funeral benefits.

The highlight of the seminar was the lively discussion, many workers shared the difficulties encountered in the process of participating in and enjoying social insurance such as: complicated administrative procedures, lack of consistency in policy implementation guidelines between units, or unclear about how to apply new regulations in Law 2024.

Representatives of Social Insurance Region I and the Diplomatic Corps Service Department directly answered and resolved each specific case, contributing to bringing peace of mind and a more complete understanding to workers. The discussion was not only an activity to provide legal information, but also an important bridge between the management agency and workers, creating consensus and mutual understanding between the parties involved.
