Speaking at the Conference, Minister Nguyen Hong Dien said that today's conference has a very special meaning. This is not only a conference to summarize the work in 2024 and deploy key tasks in 2025, but also a reunion and meeting to discuss and implement the policies of the Central Committee, the plans of the Central Steering Committee and the Government Steering Committee to summarize Resolution 18-NQ/TW of the 12th Central Executive Committee on continuing to innovate, streamline the apparatus, and operate effectively and efficiently.
Over the past year, under the synchronous and drastic leadership and direction of the Government, the Prime Minister , the National Steering Committee 389 and the close direction and management of the Party Committee and the Ministry's leaders, the Market Management force has made many efforts and creativity in implementing its tasks and has achieved remarkable results.

The richness in types, origins and prices has well met the needs of many different market segments.

The situation of law violations in commercial activities is becoming more and more complicated with increasing nature and severity. Violators do not stop at the commercial stage but also participate in the entire closed cycle, from production to distribution, putting counterfeit goods and goods that infringe intellectual property rights into circulation. The scale of violations is large, the quantity and value of infringing goods are high, many cases must be transferred to the police investigation agency to handle signs of crime.
Some typical cases include: discovering and seizing fake textbooks of the Vietnam Education Publishing House in Hau Giang and Soc Trang; producing fake golf balls in Yen Bai; fake health supplements of the Dutch Dairy Joint Stock Company; fake rice under the brand name "Mr. Cua Rice"; producing fake drugs under the brand name of Boston Vietnam Pharmaceutical Joint Stock Company and fake engines under the brand name of HBT Investment and Trading Company Limited. In addition, many cases of producing food supplements with fake labels and packaging in Hanoi and Tay Ninh were also discovered.
Notably, violations are no longer limited to small, seasonal entities but have spread to businesses and business households with full legal status and business licenses, showing more sophistication and organization in violations. The number of violations of business conditions and legal regulations in conditional business sectors is increasing, with many typical cases being detected and handled. Notable violations are in the alcohol business, such as buying and selling to the wrong subjects, outside the licensed area, or in the gasoline business, with illegal buying and selling outside the distribution system, not meeting the mandatory business conditions of the distributor.
Violations of the trading of smuggled goods, goods of unknown origin, counterfeit goods, intellectual property rights violations, and food safety violations are still complicated, especially during holidays and long vacations due to the high demand for food consumption, and the production, transportation, and trading of food products. In addition, infringing goods are gathered by subjects in border areas or transit warehouses on the circulation route to be smuggled into domestic consumption. Violations are mainly detected in high-demand goods such as fashion, cosmetics, electrical equipment, and food.
The situation of transporting and trading smuggled cigarettes tends to decrease compared to previous years. However, violations of electronic cigarettes, heated tobacco, and laughing gas have increased with violations mainly such as smuggling, goods of unknown origin, and goods of unknown quality. The provinces and cities that are hot spots for violations of this item are Hanoi, Ho Chi Minh City, An Giang, Long An, Khanh Hoa, Lang Son, Da Nang, Lao Cai, and Quang Ninh. Instead of the subjects transporting themselves or hiring others to transport them, they are now mixed in packages and sent through delivery and delivery service units, using non-owner phone numbers for transactions and sales, making it very difficult to detect.
E-commerce sector: most traders build many warehouses near border gates and set up livestream points to close orders in provinces and cities, delivering goods through delivery units. Intermediary sales accounts, order receiving and shipping locations are arranged in many different locations. Many businesses provide consignment services and use famous people with many followers on their personal pages to livestream and close orders. Due to the fast circulation of goods, the quantity and types of goods in warehouses are relatively large and often fluctuate. Specifically, in 2024, the Market Management force inspected and examined 68,280 cases (down 5% compared to the same period in 2023), detected and handled 47,135 violations (down 10% compared to the same period in 2023); transferred 178 cases with signs of crime to the investigation agency (up 2% compared to the same period in 2023). Collected over 541 billion VND to the State budget (up 8% compared to the same period in 2023). The value of infringing goods is 425 billion VND (up 23% compared to 2023), of which: the value of confiscated goods is 220 billion VND; the value of goods forced to be destroyed is 205 billion VND.
In the context of increasing issues of counterfeit goods and consumer protection in e-commerce, the General Department has advised the Ministry of Industry and Trade to coordinate with relevant ministries, localities, agencies and organizations to focus on implementing the Project on anti-counterfeiting and consumer protection in e-commerce until 2025 (Project 319), in addition to organizing surveys and assessing the quality of civil servants performing public duties to organize conferences, seminars and training courses to improve the capacity of civil servants of relevant parties; reviewing and systematizing to recommend competent authorities to improve the system of policies and laws on e-commerce activities; requesting e-commerce platforms, especially large platforms such as: Shoppe, Lazada, Tiki, TikTok, Sendo to connect and share information to serve inspection and handling of violations; strengthening screening, prevention and suppression of violations; Establish E-commerce Teams at 64 functional units in localities to promptly direct and effectively organize the implementation of tasks throughout the force.
In 2024, determining that the inspection and handling of violations in business through e-commerce activities tends to increase, in many localities, the Market Management Department of provinces and cities has proactively established 63/63 E-commerce Teams to carry out the task of grasping the situation, receiving information, and advising on the implementation of professional measures related to e-commerce cases. The Market Management force has detected and handled 3,124 violations (an increase of 266% compared to 2023), transferred 04 cases to the investigation agency, and imposed an administrative fine of 48 billion VND (an increase of 220% compared to 2023); in particular, the value of infringing goods is over 34 billion VND (an increase of 440% compared to 2023). For cross-border e-commerce platforms operating in Vietnam but not complying with legal regulations (such as Temu, Shein, 1688), the General Department of Market Management has directed units to coordinate with relevant functional forces to strengthen supervision, detection, and handling of warehouses and goods gathering points (if any) and through practical inspection, review, and recommendations to competent authorities to continue to improve policies and laws to improve operational efficiency and protect consumer rights.
At the Conference, there were 18 comments from representatives of leaders of units under the Ministry, the local Market Management Department, and the General Department assessing the operation situation as well as the coordination work of the forces and units; meeting to discuss the implementation of the Central's policies and the Plan of the Central Executive Committee, the Government Steering Committee on summarizing Resolution 18-NQ/TW of the 12th Central Executive Committee.

Focus on fighting and minimizing smuggling and trade fraud
Speaking at the Conference, on behalf of the Party Executive Committee and the Ministry's leaders, Minister Nguyen Hong Dien acknowledged, commended and warmly congratulated the results that the General Department and the entire Market Management force have achieved in the past 6 years, especially in 2024.
However, besides the achieved results, Minister Nguyen Hong Dien also frankly acknowledged that market management activities still have limitations, weaknesses, and issues that the market management force needs to focus on solving in the coming time.
In 2025, the socio-economic situation in general and the industry and trade sector in particular are forecasted to continue to have many difficulties and challenges. There are more difficulties and challenges than advantages. The open economy with the high growth rate of e-commerce (especially cross-border e-commerce) will increasingly pose more difficult and complicated problems for market management. Smuggling, trade fraud, trading in counterfeit and poor quality goods tend to increase and become more sophisticated. In addition, our country's economy has deeply integrated into the world economy, with participation in many trade agreements, which will bring many opportunities and advantages for foreign trade activities but also pose many problems in the management of imported goods, especially temporarily imported and re-exported goods.
From the above context, Minister Nguyen Hong Dien set the general goal of market management work next year as focusing on fighting and minimizing smuggling and trade fraud, striving to create a healthy production and business environment, protecting consumers and promoting domestic production.
To effectively implement the above goals and promptly overcome the limitations and weaknesses of the past time, the Minister requested the entire force to continue to innovate, improve the quality and efficiency of work, successfully and comprehensively carry out the assigned tasks in 2025, through the following tasks:
Firstly, continue to thoroughly grasp the Party's guidelines and policies, the State's policies and laws; the direction and administration of the Government, the National Steering Committee 389 and the Party Executive Committee, the Ministry's leaders (through Decrees, Circulars, Directives, Official Dispatches, etc.), together with the recommendations of relevant ministries and branches and the direction of local Party committees and authorities to properly and fully perform the functions and tasks of the Market Management force, creating a healthy environment for production and business activities.
At the same time, through the practice of management and implementation of public duties, the Market Management Force needs to continue to proactively and actively advise the Government and ministries, branches and localities to issue new (or amend and supplement) regulations, mechanisms and policies to ensure consistency and feasibility in order to improve the effectiveness and efficiency of the entire force's operations. "Even if the management model is changed, however, how that model is designed, what are the functions and tasks... the opinions of comrades in the future are important. The Ministry continues to listen to opinions, and requests that the Market Management Force continue to advise competent authorities to have specific and clear regulations to promote its role in the future" - Minister Nguyen Hong Dien emphasized.
Second, further strengthen market inspection, examination and control (especially during Tet and holidays) to promptly detect and strictly handle violations, especially common violations in the production and trading of counterfeit, poor quality goods and goods of unknown origin.
In the context that the whole country is actively and urgently implementing Resolution 18/NQ-TW, Minister Nguyen Hong Dien especially reiterated the spirit of determination, not to leave any gaps, not to let any interruptions in the implementation and execution of the market inspection and supervision tasks of the Market Management Force.
“The tasks of the Market Management force under the direction of the Ministry of Industry and Trade and the General Department of Market Management must still be thoroughly implemented by local Market Management forces. Implementation will be carried out until the new legal document comes into effect, then it will be changed according to the new regulations” - The Minister once again noted and requested the Market Management force to continue to focus on inspecting and handling violations in essential industries such as: gasoline, fertilizer; foods, beverages, cigarettes (especially new generation cigarettes); functional foods, medicines, cosmetics, fashion goods, electronics...
At the same time, strengthen closer coordination with forces in the fight against smuggling and trade fraud in e-commerce, especially seriously and effectively implementing the Resolution of the National Assembly Standing Committee on the supervision of e-commerce and the directions of the Government and the Ministry of Industry and Trade in the field of e-commerce (such as the Project on anti-counterfeiting and consumer protection in e-commerce until 2025; Directive No. 18 of the Prime Minister on promoting connection and data sharing to serve e-commerce development, combat tax loss, ensure monetary security; strengthen post-inspection work in the management of e-commerce activities).
Third, focus on rectifying discipline, administrative discipline in the direction and management and the awareness of law compliance of civil servants in the entire force. Strengthen internal inspection and examination work; resolutely and strictly handle in accordance with Party regulations and State laws organizations and individuals who violate the law, especially acts of protection, corruption and negativity in the performance of public duties.
The industry commander also noted that during the transition period, there may be more violations, so leaders of the Market Management force need to pay attention, warn early and handle strictly if the above incident occurs.
Fourth, continue to promote information and communication work to create unity in awareness, consensus in action and sharing and support from society for the industry's activities; at the same time, focus on applying information technology and digital transformation in all activities, creating stronger changes in all aspects of work in the entire force.
Fifth, urgently complete the organization and apparatus arrangement of the Market Management force in the coming time according to the Central's policy and the plan of the Central Executive Committee, the Government Steering Committee as well as the Politburo.

Regarding the task of reorganizing the apparatus of the Market Management force, Minister Nguyen Hong Dien said that, implementing the policy of the Politburo and the requirements and orientations of the Central Steering Committee and the Government Steering Committee on reorganizing and streamlining the apparatus, the Party Committee and the Ministry's leaders have agreed and reported to the Government Steering Committee on the expected termination of the organizational model of the General Department of Market Management and transferring the local Market Management Departments to the People's Committees of provinces and cities for management, and proposing the model of Market Management Sub-Departments under the Department.
"This is quite regrettable, but this is something that cannot be left undone and cannot be delayed any further. Therefore, in order to carry out this particularly important task well, I request that the Party Committee, the leaders of the General Department of Market Management and the local Market Management Departments thoroughly grasp and seriously implement the Politburo's policy and the requirements and directions of the Central Steering Committee, the Government Steering Committee and the Party Committee, the leaders of the Ministry of Industry and Trade on streamlining the organizational apparatus. The heads of agencies and units need to promote a high sense of responsibility, be exemplary, and determined in implementing this task" - Minister Nguyen Hong Dien emphasized and directed that the entire force needs to do a good job in political and ideological work and personnel work.
The Minister also noted that it is necessary to thoroughly explain the change in the operating mechanism, without changing the nature, functions and tasks of the Market Management Force for cadres throughout the system, especially cadres at the team and grassroots levels. Pay attention to the arrangement and implementation of policies for cadres in a satisfactory manner. The Ministry will design a mechanism to ensure policy benefits for managers and civil servants performing public duties, creating high consensus and unity in awareness and action throughout the force and each agency and unit.
Minister Nguyen Hong Dien also suggested that the entire force identify that the restructuring of the apparatus is something that needs to be done and must be done immediately, but it must be done objectively, democratically, scientifically, ensuring streamlining, efficiency, effectiveness, and efficiency (rather than mechanical arrangement), in order to minimize overlap and ambiguity in functions and tasks between units (Groups, Teams).

In particular, the Minister requested that it is necessary to focus on effectively implementing the Peak Plan against smuggling, trade fraud and counterfeit goods in the last months of 2024; before, during and after the Lunar New Year 2025, which has been issued, to ensure market stability and well serve the needs of people celebrating the Spring Festival.
“In the process of organizing and implementing the internal apparatus arrangement and organization, the General Department and local Market Management Departments must closely follow the requirements, all activities of the force must take place normally in accordance with current regulations. There must absolutely be no loopholes in management or crises in the system; it is necessary to thoroughly grasp and implement the orientation of streamlining the apparatus organization of the Government Steering Committee and the Ministry's Steering Committee to ensure quality, implementation progress and minimum assigned arrangement targets” - the Minister once again emphasized.
At the same time, the Minister also reminded the Market Management force about issues related to handling finance, budget, public assets and transitional management of public investment projects in the process of arranging and perfecting the organizational apparatus.
In addition, the current General Department of Market Management and the new planned unit in the future and related units in the Ministry such as the Legal Department and the Personnel Department need to proactively research, advise, and propose to competent authorities to issue new or amend and supplement regulations, policies and mechanisms suitable for the new organizational model to ensure that the new organizational model is better than the old model and must be put into operation immediately, without interruption of work, without management gaps, and without leaving vacant areas of responsibility.
On the side of the Ministry of Industry and Trade, the Party Committee and the leaders of the Ministry of Industry and Trade will proactively make recommendations to competent authorities, as well as discuss and work with relevant ministries, branches, and local Party committees and authorities to have reasonable personnel policies, creating conditions for cadres and civil servants in the Market Management force to better carry out new tasks when implementing the arrangement and consolidation of the apparatus organization according to the new model.
Receiving the instructions of Minister Nguyen Hong Dien, General Director Tran Huu Linh said that the entire force will seriously implement the instructions of the Minister and no matter which unit the Market Management force is in, it will demonstrate the mettle of a loyal soldier, promote its role and tasks well, and become the main force, the core force in the work of market inspection and control.
