At the conference of full-time National Assembly Deputies (from April 5-7), giving opinions on the draft Land Law (amended), many National Assembly Deputies emphasized the importance of collecting public opinions on land use planning and plans; it is necessary to publicize information on land use planning and plans so that people know, contributing to reducing complaints and negativity.

Specifically, National Assembly member Ma Thi Thuy ( Tuyen Quang ) suggested that the Drafting Committee should stipulate that collecting public opinions on land use planning and plans is a mandatory step in the process of making land use planning and plans. At the same time, it is necessary to clearly identify the subjects of people who are consulted, and should not stipulate general subjects of people who are consulted as in the draft Law. Accordingly, the people who are consulted are organizations and individuals located in the areas affected by land use planning and plans.

Regarding the public announcement of planning and land use plans, the draft Law stipulates that they must be made public at the agency's headquarters. National Assembly member Ma Thi Thuy said that this provision is still a formality, because it is difficult for people to access the headquarters of agencies to view and study planning and land use plans.

Therefore, the Delegate proposed that the Drafting Committee add some forms of publicity such as broadcasting on the district and commune loudspeaker systems and through conferences in villages and residential groups as prescribed in Clause 1, Article 12 of the Law on Grassroots Democracy Implementation in 2022.

The more widely we consult, the more we can limit complaints and negativity.

Regarding the same issue, National Assembly Deputy Nguyen Thi Viet Nga ( Hai Duong ) emphasized that the consultation on land use planning and plans should be given special attention. Article 66 of the draft Law stipulates the consultation on land use planning and plans, accordingly, depending on the level of planning and land use planning, there will be different forms of consultation. The delegate said that the forms stipulated in the draft Law are quite rich, diverse and have the application of 4.0 technology.

To avoid the process of collecting opinions on planning and land use plans becoming a formality, a procedure, and ineffective, Delegate Nguyen Thi Viet Nga suggested that it is necessary to regulate the public posting of opinions at the office or electronic information portal, and must be announced to the people. The announcement of the location and time of publicizing planning and land use plans can be done through forms that are easier for people to see and hear, such as through loudspeakers and local television channels.

Currently, many people do not regularly go to the offices of the commune, district or province, especially in rural areas. Not to mention the barriers of writing, language or the level of using information technology. Therefore, if they are not informed that the planning and land use plan have been made public for consultation, many people will not know to participate in giving their opinions. This is content that directly affects people's lives, so the more widely the consultation is conducted, the more opinions will be attracted, and in the future, it will limit negative reflections and complaints from people, emphasized Delegate Nguyen Thi Viet Nga.

Therefore, Delegate Nguyen Thi Viet Nga proposed to continue reviewing legal regulations, building favorable relationships and processes to implement unified planning and land use plans at district, provincial and national levels; promoting the responsibility of agencies making planning and land use plans at each level to limit the current passive planning adjustments of localities.
