Blocking tricks to lure students into opening bank accounts for fraud

The State Bank has just sent a document to the People's Committees of provinces and cities regarding coordination to prevent the buying and selling of payment accounts of students.

According to the State Bank, through monitoring and grasping the actual situation along with feedback from the Ministry of Public Security, it shows that recently in some provinces and cities, there have been subjects enticing students to open payment accounts, then transferring them to these people to use.

Criminals lure and entice students who have been issued citizen identification cards (CCCD) to open payment accounts and pay them to open them. These people provide students with phones with available SIM cards to register to open payment accounts and Internet Banking and SMS Banking services.

Then, they asked the students to return their phones, provide their name, login password, and authentication password (OTP)... Notably, these subjects also collected students' biometric data (face) to verify the customer's identity when requested.

According to the State Bank's regulations, a fine of 50 million to 100 million VND will be imposed if one rents, leases, borrows, lends payment accounts, buys, or sells payment account information in a quantity of 10 or more payment accounts without being subject to criminal prosecution.

"These accounts are then often used for illegal purposes such as money laundering, tax evasion, property fraud, and terrorist financing," the State Bank stated.

Recently, the management agency has issued a series of regulations on prohibited acts and administrative penalties for violations in opening and using payment accounts. Specifically, Decree 52/2024/ND-CP issued in May 2024 on non-cash payments strictly prohibits the provision of dishonest information related to the provision or use of payment services, payment intermediary services, etc.

Current regulations also prohibit opening or maintaining anonymous or impersonated payment accounts or e-wallets; buying, selling, renting, leasing, borrowing, lending payment accounts or e-wallets; renting, leasing, buying, selling, opening bank cards (except for anonymous prepaid cards).

Theft, collusion to steal, purchase, or sale of payment account information, bank card information, or e-wallet information are also violations of the law. At the same time, payment account holders are not allowed to rent, lend, or purchase or sell payment accounts.

In case of leasing, lending, buying and selling from 1 to less than 10 payment accounts, buying and selling payment account information, the fine will be from 40 to 50 million VND.

Fines from 50 million to 100 million VND for renting, leasing, borrowing, lending payment accounts, buying, selling payment account information with a quantity of 10 or more payment accounts without being prosecuted for criminal liability.

Faced with this situation, to ensure the opening and use of payment accounts in accordance with regulations, the State Bank recommends that the People's Committees of provinces and cities direct the Department of Information and Communications, media agencies and press to increase propaganda and warnings to people and organizations and individuals in the area, especially students, university students and minors about the methods and tricks of criminals.

"The People's Committees of provinces and cities also direct schools andeducational institutions in the area to promptly inform all students and parents about the methods and tricks of criminals, prohibited acts in opening and using payment accounts and regulations on administrative sanctions to raise awareness of law compliance and prevent them from being exploited for illegal purposes," the State Bank's document stated.
