According to Decree 12/2022/ND-CP, if violating regulations on working hours and rest hours, employers will be fined 2-5 million VND for not ensuring employees have personal leave or unpaid leave according to the law or not notifying in writing the Department of Labor - Invalids and Social Affairs (now the Department of Home Affairs) - the place where overtime is organized and the head office about organizing overtime from more than 200 hours to 300 hours in a year.
In addition, employers who violate the law on weekly or annual leave or holidays will be fined 10-20 million VND...
Accordingly, if the employer is an organization, the fine is twice that of an individual. Thus, if the employer violates the regulations on Tet holidays, the fine is 10-20 million VND for individuals. As for organizations, the fine will be 20-40 million VND.
On the other hand, employers can organize work if there is consensus of employees on this occasion. In addition to holiday pay, employees are also paid overtime.
Therefore, in case an employee wants to work on a holiday, they will be paid overtime. Accordingly, the employee will be paid overtime on holidays, Tet or paid leave at least 300% of the normal daily salary.
Overtime wages are determined according to Article 98 of the Labor Code as follows: Overtime wages during the day = 300% x Unit price of wages or actual wages paid according to the work being done. Overtime wages at night = 390% x Unit price of wages or actual wages paid according to the work being done.
