In the draft Investment Law (amended) submitted to the National Assembly on the morning of November 11, the Government proposed to review and cut 25 conditional investment and business sectors that do not meet the criteria and conditions prescribed in Article 7 of the Investment Law.
Minister of Finance Nguyen Van Thang said that this revised law aims to reduce and simplify investment, business, practice conditions, and unreasonable administrative procedures...
Regarding the reason for the proposed reduction, Mr. Thang said that there are currently 234 industries and professions that must apply for a license to operate, most of which apply a pre-inspection mechanism.
According to him, these industries and professions can switch to a post-inspection mechanism to limit barriers to business entry into the market, promote business freedom and implement Resolution No. 66 of the Government on cutting and simplifying administrative procedures related to production and business activities in 2025 and 2026.

The Government also proposed to abolish the procedure for approving foreign investment policies (authority of the National Assembly and the Prime Minister).
Along with that, the Government proposed to narrow down the scope of projects that must carry out procedures for granting overseas investment registration certificates, applying only to projects with investment capital of 20 billion VND (about 760,000 USD) or more or investment projects in conditional overseas investment sectors and professions.
In case of necessity, the Ministry of Finance shall delegate the authority to grant, adjust, and revoke the Certificate of Registration for Foreign Investment to organizations under the Ministry, according to the drafting agency.
In addition, the Government proposed that for projects with a scale of less than 20 billion VND and not in the conditional foreign investment sectors and professions, they only need to register foreign exchange transactions with the State Bank to transfer money abroad.
Examining this content, the National Assembly's Economic and Financial Committee proposed to continue researching, reviewing, streamlining, and cutting down on conditional investment and business sectors and professions, substantially cutting down on investment and business conditions, and only retaining the truly necessary conditions.
Along with that, the appraisal agency proposed a clear distinction between the practice conditions of individuals and the investment and business conditions of business investors when investing and doing business in the form of an organization or business legal entity.
In addition, the inspection agency proposed to continue to carefully review and research regulations in the direction of not abolishing conditional investment and business sectors, changing management methods, eliminating pre-inspection administrative procedures, and switching to post-inspection management.
The Government has proposed to reduce licenses for 25 conditional business sectors and occupations, including:
Finance - accounting field: Practicing forensic expertise in the fields of finance, banking, construction, antiques, relics, copyright; accounting services; tax procedure services.
Agriculture, forestry and fishery: Rice export; temporary import and re-export of frozen foods; breeding and growing wild plants and animals listed in the CITES Convention appendix and the list of endangered, precious and rare wild plants and animals and aquatic products; breeding of wild animals.
Export - import, re-export, import from the sea of natural specimens of species listed in the appendices of the CITES Convention and the list of endangered, precious and rare forest and aquatic animals and plants; export - import, re-export of specimens of breeding, rearing, artificial cultivation of species listed in the appendices of the CITES Convention and the list of endangered, precious and rare forest and aquatic animals and plants.
Processing, trading, transporting, advertising, displaying, and storing specimens of plants and animals listed in the appendices of the CITES Convention and the list of endangered, precious, and rare forest and aquatic plants and animals; trading in food under the specialized management of the Ministry of Agriculture and Environment; quarantine services for animals and animal products.
Construction, transportation: Automobile warranty and maintenance services; inland waterway vehicle building, repair and restoration services; ship building and repair services; construction investment project management consultancy; construction by foreign contractors.
Technology, land: Services of building information technology infrastructure, land information software; services of building land database; business of data center services.
Culture, society and health: Labor leasing services; study abroad consulting services; cosmetic surgery services; performing arts services, fashion shows, beauty and model contests; management and operation services of crematoriums.
