Allow international schools in Vietnam to invest in phases

Accordingly, for foreign-invested general schools, the project must have an investment rate of at least 50 million VND/student, excluding land use costs.

The total minimum investment capital is calculated based on the time of highest expected scale, but not less than 50 billion VND.

At the same time, by the time of appraisal to alloweducational activities, the project must have implemented more than 50% of the total capital.

Investors must commit to investing sufficient capital within 5 years from the date of the decision to permit operation.

The Decree also raises the minimum investment capital requirement from VND250 billion to VND500 billion for branches of foreign universities in Vietnam.

Similar to the high school project, the university branch project must also have an investment of over 250 billion VND (equivalent to 50% of the capital) by the time of appraisal for establishment permission.

Compared to Decree 86 of 2018, Decree 124 amends and supplements regulations on investment roadmaps according to progress. This creates favorable conditions for educational institutions to ensure operational efficiency in the initial stage, the newly established stage, when the number of students is still small and there are not many sources of income.

The Decree also adds regulations on the responsibility of schools to disclose information to students, parents and society.

The contents that must be made public include: educational programs and assessment results, number of foreign teachers, number of foreign students, testing methods, and assessment of learning outcomes.

In addition, Decree 124 "tightens" regulations on educational programs, especially at preschool and general education levels.

Accordingly, foreign educational programs, if implemented in Vietnam, must be taught directly for at least 5 years in the host country, recognized by competent foreign educational agencies or organizations, or have their quality assessed.

This program must also ensure that educational goals are consistent with those of Vietnam.

Schools must also be responsible for reporting and asking for opinions from the local Department of Education and Training on the education program within 6 months from the date the Decree takes effect on November 20.
