According to the petition of citizen Ha Van Nghi, his family has land plot No. 493, map sheet No. 14, area of ​​2,000 m2 of residential land, which was granted Land Use Right Certificate No. B784000 by the People's Committee of Pho Yen District (now the People's Committee of Pho Yen City) on August 6, 1993. In 2008, the State reclaimed 1,790.3 m2 of land from Mr. Ha Van Nghi's family to implement the new National Highway 3 Project Hanoi - Thai Nguyen. On December 23, 2022, Mr. Ha Van Nghi submitted a petition to the Branch of the Pho Yen City Land Registration Office to measure and re-issue the remaining area after the land was reclaimed to implement the Project. On January 5, 2023, the Branch of the City Land Registration Office. Pho Yen has conducted measurements and issued Notice No. 694/TB-CNPY dated April 25, 2023 with the following content: “The remaining area of ​​plot 493(4) is 209.7 m2. Comparing the cadastral map and the land clearance map of the new National Highway 3 construction project, the section connecting Hanoi - Thai Nguyen shows that the recovered area in plot 493 is 1,497.5 m2. Therefore, according to the adjustment of the 2009 Certificate of Land Use Rights of Mr. Ha Van Nghi, there is not enough basis for the Branch of the Land Registration Office to accept and return the result to Mr. Ha Van Nghi”.

Mr. Ha Van Nghi said that the reissuance of the Land Use Right Certificate for the remaining area after the recovery of land plot No. 493 has not been implemented because the actual land area recovered in 2008 has not been determined. In order for the family to have a basis to be reissued the Land Use Right Certificate, the citizen requested the Chairman of the Provincial People's Committee and competent authorities to consider and resolve and respond, clearly explaining the recovered land area and the remaining area so that the family can stabilize their lives.

After listening to the citizens' opinions and the solution to the case of the relevant agencies, Chairman of the Provincial People's Committee Nguyen Huy Dung said: The content of the request of citizen Ha Van Nghi is legitimate, with full basis for consideration and settlement. Therefore, to ensure the maximum legitimate rights and interests of the people, the Chairman of the Provincial People's Committee assigned the People's Committee of Pho Yen City to preside over and coordinate with the Department of Natural Resources and Environment and relevant agencies and units to review the land use process, determine the boundaries, area, land type and issue a Land Use Right Certificate to Mr. Ha Van Nghi for the remaining land area of ​​the family according to the provisions of law. The completion time is before November 30, 2024.

The Chairman of the Provincial People's Committee assigned the Department of Natural Resources and Environment, the Provincial Land Registration Office and relevant agencies and units to coordinate with the People's Committee of Pho Yen City to implement in accordance with legal regulations; requested Mr. Ha Van Nghi to coordinate with relevant agencies during the implementation process.

The Chairman of the Provincial People's Committee also assigned the Provincial Citizen Reception Committee to regularly monitor and urge the implementation of tasks of units and localities for cases with conclusions to synthesize and report to the Provincial People's Committee according to regulations.
