In October 2024, the Provincial People's Committee issued Plan No. 231/KH-UBND on the implementation of transferring power projects with voltage levels up to 110kV, which are public assets in the province, to EVN. According to the plan, the roadmap for handling power project transfer dossiers is about 40-45 dossiers/month. However, by early April 2025, the whole province had only 9/661 projects handed over to the Electricity sector.
According to the Department of Industry and Trade's synthesis of data provided by units and localities, the number of power projects within the scope of regulation that need to transfer assets to EVN in the province is 661 projects. The transfer is carried out according to the direction of the Government in Decree No. 02/2024/ND-CP issued (January 10, 2024) on the transfer of power projects that are public assets to EVN (Vietnam Electricity Group).
During the implementation process, the Department of Industry and Trade issued many documents, urged, supported and guided the units and organized working sessions to review, grasp, discuss solutions to remove difficulties and obstacles as a basis for guiding and implementing the transfer of power projects. Quang Ninh Electricity Company (the unit receiving the handover, management and operation) received 125 sets of documents from the units.
However, the progress of the handover has not ensured the progress according to the plan assigned by the Provincial People's Committee. Currently, the whole province has only 9 projects received, including 8 projects under the People's Committee of Tien Yen district and 1 project under the People's Committee of Ha Long city. Through the assessment and review of Quang Ninh Electricity Company, many projects cannot be received due to the following reasons: Original documents are lost, especially for projects that have been invested in for a long time; projects that are jointly implemented by the State and the people or have not completed the documents for land allocation, land lease, investment decisions, settlement documents, completion documents, etc.; the technical infrastructure of some power projects that have been invested and put into use for a long time (many projects over 10 years) has degraded; the general situation is that transformer station shells, meter cabinets are rusty, cables and wires are lost, some projects have incidents, etc., not ensuring safety for operation; Many projects have difficulty in determining asset depreciation, assessing the remaining value of assets, and have not yet determined the method of asset transfer for power projects invested with state capital and people's contributions.
On the other hand, there are still 5 localities that have not sent official dispatches requesting Quang Ninh Electricity Company to receive and hand over power projects, including: Quang Yen, Dong Trieu, Binh Lieu, Ba Che, Ha Long. For the remaining localities, although official dispatches have been sent, there are still some localities where when the Electricity sector comes to work directly, the relevant departments and offices have not joined in to implement the next steps.
In addition to the above reasons, many problems have also arisen in the actual implementation of Decree No. 02/2024/ND-CP. Mr. Nguyen Quang Thai, Deputy Head of the Supervision Consulting Department (Ha Long City Investment and Construction Project Management Board) said: Currently, there are 155 projects in the city that need to be handed over, but due to lost documents, the completion takes a lot of time and money. The provincial authorities have not yet provided specific instructions on whether the relocated, renovated, refurbished, and underground power projects are within the scope of transfer according to the provisions of Decree No. 02/2024/ND-CP; the order and procedures for transferring power projects belonging to shared technical infrastructure in urban and residential area projects, in case the power project assets are deducted from the project's land use fees, leading to confusion on the Board and the entire Electricity sector in the process of completing the acceptance documents.
The above difficulties of Ha Long City are also common difficulties of many localities and units in the province. In order to speed up the handover of power projects according to Decree No. 02/2024/ND-CP, on April 16, the Provincial People's Committee issued Document No. 1085/UBND-XDMT. Accordingly, it requires agencies, organizations and units that are investors to urgently prepare documents and complete the handover work according to plan. On the side of the Department of Finance, it guides the determination of the scope of transfer of renovation, underground, urban embellishment works, works with people's contributions, power works belonging to technical infrastructure projects invested with state capital. The Department of Agriculture and Environment guides the re-establishment of land records associated with power projects. The Department of Construction guides and determines the implementation of partial handover in stages. On the side of localities, continue to work with investors to remove difficulties and obstacles...
In the context of the dissolution of the district level from July 1, the acceleration of the handover of local power projects to the Electricity sector becomes more urgent. Especially when many areas have overloaded and degraded power systems but have not been handed over, leading to the Electricity sector having no basis for investment, maintenance and repair.
