Announcement of the President's Order on 16 laws and ordinances just passed by the National Assembly

Speaking at the press conference, Mr. Pham Thanh Ha, Deputy Head of the Office of the President, announced the President's Order on 13 laws and 3 ordinances. Representatives of relevant ministries and branches also introduced the basic contents and outstanding new points of these laws and ordinances.

Presenting the new points of the Law amending and supplementing a number of articles of the Penal Code, Senior Lieutenant General Le Quoc Hung, Deputy Minister of Public Security, said: the law has abolished the death penalty for 8 crimes, aiming to concretize the Party's policy on humanizing punishment, in line with international legal trends.

Notably, the transitional provisions of the law provide guidance on handling situations arising with people who have been sentenced to death for crimes that abolished the death penalty in the law before July 1 but have not yet been executed.

Accordingly, the provisions of this law, if not beneficial to the offender, shall not apply to crimes committed before 0:00 on July 1 but only discovered after that time or being investigated, prosecuted, or tried, except for cases of embezzlement of property and bribery.

Death sentences imposed before July 1 on criminals for crimes for which the death penalty has been abolished or for cases where the death penalty cannot be carried out due to terminal cancer and the sentence has not yet been carried out will not be carried out and the Chief Justice of the Supreme People's Court will decide to convert the death penalty to life imprisonment.

The death penalty was imposed before July 1 on those who committed the crime of illegal drug production and illegal drug trafficking, and the quantity or volume of the drug determined in the judgment to decide the death penalty for them is greater than the minimum quantity or volume of the drug prescribed in the amended and supplemented articles of the law, but the offender is not the mastermind, leader, commander or does not have two or more aggravating circumstances and has not yet served the sentence, then the sentence will not be served and the Chief Justice of the Supreme People's Court will decide to convert the death penalty to life imprisonment.

The law amending and supplementing a number of articles of the Penal Code doubles the fine for 24 crimes. The increased penalties focus on crimes related to counterfeit goods, the environment, food safety, and corruption.

Regarding the Law on Cadres and Civil Servants (amended) , Deputy Minister of Home Affairs Truong Hai Long emphasized: this is an important step in institutionalizing major resolutions of the Central Committee on cadre work and civil service regime, especially institutionalizing breakthrough resolutions, contributing to building a modern and professional Vietnamese civil service...

Meanwhile, according to Mr. Le Tien Dat, Deputy Inspector General of the Government, the Law on Inspection (amended) has added a number of contents to suit the arrangement of the inspection agency system, strengthening the working relationship between the Government Inspectorate and ministries, branches, between the Provincial Inspectorate and departments, branches and People's Committees at the commune level; ensuring the synchronization and unity of the legal system, leaving no legal gaps when arranging the inspection agency system.

To ensure that the provisions of the amended laws are effectively implemented, representatives of ministries and branches all emphasized the need to urgently develop draft decrees to submit to the Government; and develop and issue circulars within their authority.

The Laws and Ordinances announced at the press conference include:

- Law amending and supplementing a number of articles of the Law on Promulgation of Legal Documents

- Law amending and supplementing a number of articles of the Law on Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Implementing Democracy at Grassroots Level

- Law on Cadres and Civil Servants

- Law amending and supplementing a number of articles of the Law on Vietnamese Nationality

- Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations

- Law amending and supplementing a number of articles of 11 laws on military and national defense

- Inspection Law

- Law amending and supplementing a number of articles of the Law on Bidding, the Law on Investment under the public-private partnership model, the Customs Law, the Law on Value Added Tax, the Law on Export Tax and Import Tax, the Investment Law, the Law on Public Investment, and the Law on Management and Use of Public Assets.
