Deputy Prime Minister Tran Hong Ha requested to summarize and evaluate the implementation of the pilot contract bonus in construction and installation packages prescribed in Decree No. 15/2023/ND-CP dated April 25, 2023.
On April 25, 2023, the Government issued Decree 15/2023/ND-CP regulating the pilot contract award for construction and installation packages of transport projects under the Socio-Economic Recovery and Development Program.
The list of projects subject to the provisions on pilot contract rewards attached to this Decree includes 15 projects: The North-South Expressway Construction Project in the East phase 2021-2025; Khanh Hoa - Buon Ma Thuot Expressway Construction Investment Project Phase 1; Bien Hoa - Vung Tau Expressway Construction Investment Project Phase 1; Chau Doc - Can Tho - Soc Trang Expressway Construction Investment Project Phase 1; Cao Lanh - An Huu Expressway Construction Project Phase 1;...
Contract bonuses must comply with the following principles: Construction works and construction items must be performed in accordance with the contract (in terms of quantity, volume, quality), meet technical standards and regulations, and must be accepted and handed over in accordance with construction law.
Contract awards must be public, transparent and fair; must be clearly stated in the bidding documents, request documents and shown in the contract signed between the investor and the contractor.
Contract bonuses are applied to each specific bid package. The bonus amount must not exceed the bonus source specified in Article 4 of Decree 15/2023/ND-CP.
Contract bonuses are only applicable to contractors who comply with the law in implementing the package and have actual bonus funds.
Bonuses are not applied to cases of determining bid package prices, preparing bidding documents, request documents and signing contracts not in accordance with construction law regulations in order to profit from bonuses.
After more than 1 year of implementation, in Official Dispatch No. 7810/VPCP-CN dated October 24, 2024, Deputy Prime Minister Tran Hong Ha assigned the Ministry of Construction to preside over and coordinate with relevant agencies to summarize and evaluate the implementation of the pilot contract award in construction and installation packages specified in Decree No. 15/2023/ND-CP dated April 25, 2023, propose feasible, effective and legally compliant solutions, on the principle of ensuring publicity, transparency and fairness in the implementation of mechanisms and policies.
