Proposed 7 ways traffic police use to detect traffic violations

The Ministry of Public Security (the drafting unit) has just completed the draft Law on Road Traffic Order and Safety.

Add new forms to detect traffic violations

In the draft, the Ministry of Public Security proposed measures that the traffic police force can use to detect violations of laws on road traffic order and safety.

Specifically, Article 66 of the draft Law on Road Traffic Order and Safety clearly states that patrol and control forces can use seven methods to detect traffic violations.

Firstly, the system is operated and used to monitor security, order, and handle violations of road traffic order and safety.

Second, use traffic control camera system and technical equipment system to control vehicle load.

Third, traffic police are allowed to use additional technical equipment, vehicles, and smart devices to support traffic control.

Fourth, the authorities are allowed to exploit data from journey monitoring devices, record images of drivers, ensure journey safety according to regulations; receive data collected from vehicle load control works.

Fifth, traffic police are allowed to exploit and use information in the database on road traffic order and safety.

Sixth, when patrolling and checking, traffic police also observe, check, control and directly compare to detect violations on the road.

Seventh, the Traffic Police will receive and process reports, feedback, recommendations, and data collected from vehicles and technical equipment of organizations and individuals according to Government regulations.

Thus, compared with current regulations on forms of patrolling and controlling traffic order and safety, the Draft has added new forms such as: Through the traffic control camera system and the system of technical equipment for controlling the load of motor vehicles; Smart devices supporting traffic command; Journey monitoring devices, recording images of drivers, ensuring journey safety according to regulations; Receiving data collected from vehicle load control works; Information in the database on road traffic order and safety.

Cases where traffic police are allowed to stop vehicles for inspection and control

In addition, in Article 65, this draft stipulates that traffic police are allowed to stop vehicles participating in road traffic for inspection and control when there is one of the following grounds.

First, when detecting a violation of the law or having grounds to determine that there is a violation of the law on public order, road traffic safety or other violations of the law.

Second, follow the orders and patrol and control plans of competent authorities to detect violations of laws on road traffic order and safety that require stopping vehicles for inspection.

Third, serving the protection of national security, maintaining social order and safety, and fighting and preventing crimes; preventing and combating natural disasters; preventing and fighting fires and rescuing; and preventing and combating epidemics.

Fourth, there are reports, denunciations, reflections, recommendations, and requests from agencies, organizations, and individuals about crimes and other violations of the law.
