The Ministry of Construction said that on November 27, 2023, at the 6th Session, the 15th National Assembly passed the 2023 Law on Real Estate Business with 10 Chapters and 83 Articles. In this Law, the National Assembly assigned the Ministry of Construction to detail the framework program for training and fostering knowledge of real estate brokerage practice and real estate trading floor management.
On January 8, 2024, the Prime Minister issued Decision No. 19/QD-TTg on the list and assignment of the agency in charge of drafting documents detailing the implementation of laws and resolutions passed by the 15th National Assembly at the 6th Session, in which the Government assigned the Ministry of Construction to preside over and coordinate with relevant ministries and branches to research, develop and promulgate under its authority a Circular guiding the framework program for training and fostering knowledge of real estate brokerage practice and real estate trading floor operations.
Therefore, it is necessary to research and draft a Circular guiding the framework program for training and fostering knowledge of real estate brokerage practice and real estate trading floor management to ensure timely entry into force with the enforcement of the Law on Real Estate Business 2023.
According to the draft, the framework program for training and fostering knowledge of real estate brokerage practice includes knowledge of real estate business and professional knowledge of real estate brokerage.
Knowledge of real estate business
Knowledge of real estate business, including 11 topics and contents.
Topic 1: Laws related to real estate business, including main contents: Conditions for organizations and individuals when doing real estate business; conditions for types of real estate put into business; regulations on transferring real estate projects; trading in land use rights with technical infrastructure in real estate projects; contracts in real estate business activities; information about real estate, real estate projects put into business; other contents in the law on real estate business.
Topic 2: Laws related to land, including the following topics and main contents: Regulations on granting Certificates of land use rights, house ownership rights and other assets attached to land; rights and obligations of land users; forms of land use and collection of land use fees.
Topic 3: Investment law, including main contents: Procedures for implementing a real estate business investment project; contents of real estate business investment projects;
Topic 4: Civil law related to real estate business activities: Issues related to legal entities; regulations on civil transactions
Topic 5: Law on notarization related to real estate business activities: Legal regulations on notarization of contracts related to real estate business activities; documents and procedures for establishing enterprises in the field of real estate business.
