Proposal to exempt road fees for many types of cars

The Ministry of Construction proposed that cars that are temporarily seized, temporarily detained, or suspended from circulation for 30 days or more are not subject to road use fees; funeral vehicles such as passenger cars accompanying the hearse, flower trucks, photo-carrying cars, etc. are allowed to use the road for free.

Proposal to exempt road fees for many types of cars

The implementation of Decree 90/2023 on collection, payment, exemption and management of road use fees has given rise to a number of new problems.

According to statistics from the Ministry of Construction , after implementing Decree 90/2023 on collection, payment, exemption and management of road use fees, 2024 is the first year that the total road use fee revenue exceeds the threshold of 14,000 billion VND; this revenue source contributes significantly to the annual growth in state budget revenue; is the basis for allocating increased funding for maintenance and repair of the road traffic system nationwide.

However, new problems have arisen during the implementation of the Decree. Typically, vehicles are temporarily seized or detained for 30 days or more, vehicles with expired registrations that do not participate in road traffic are still subject to additional fees. The regulation of toll rates for public passenger buses (including vehicles carrying students, workers and workers that enjoy subsidy policies like buses) to enjoy the same price as cars with less than 10 seats is unreasonable.

Therefore, in the document sent to the Ministry of Finance for comments on amending Decree 90/2023; for cases where cars are not subject to road use fees, the Ministry of Construction proposed to add cars that are temporarily confiscated, temporarily detained and temporarily suspended from circulation continuously for 30 days or more.

"In reality, there have been many cases where vehicles were temporarily seized or detained by authorities because they were evidence related to smuggling, gambling, traffic accidents... and in these cases, the vehicles did not use the road traffic system," the Ministry of Construction explained.

On the other hand, many organizations and individuals have reported that the Decree only stipulates that transport vehicles that have been suspended from operation for 30 consecutive days or more are not subject to road use fees, which does not ensure fairness for all vehicle owners. Therefore, the Ministry of Construction proposes that all vehicles that have been suspended from operation for 30 consecutive days or more are not subject to road use fees.

The Department of Transport and Construction has proposed that funeral vehicles, including hearse-passenger vehicles, flower trucks, and photo-carrying vehicles, be allowed to use the roads for free. The Department said that previously, due to the decree stipulating that only funeral service units were allowed to use the roads for free, many funeral service businesses were not considered for exemption from paying road use fees.

In the case of refunding or offsetting paid road use fees, the Ministry of Construction wishes to amend as follows: For cars specified in Point c, Clause 2, Article 2 of this Decree, before taking the car for repair, the car owner must present a police-certified accident scene report and return the inspection stamp and inspection certificate to the nearest inspection facility, in order to have a basis for refunding the fee after the car has completed the repair and re-inspection to continue operating. If the above documents are damaged or lost when the car is involved in an accident, there must be a police or insurance certificate related to the handling of the accident.

The Ministry of Construction explained that due to many cases of vehicles being involved in accidents (including fires), the stamps and inspection certificates were completely damaged, so the vehicle owners could not comply with the regulations to get a refund or offset the road use fees paid...
