Businesses are rushing to withdraw their cosmetic declaration acceptance numbers, is it to avoid post-inspection?

As authorities are focusing on combating and inspecting cosmetic products, many businesses have requested to withdraw their cosmetic declaration certificates. In just one day, the Drug Administration of Vietnam (Ministry of Health) issued a decision to withdraw nearly 300 cosmetic declaration certificates, including Dove shower gel products and Bioderma makeup remover.

Recently, the police in many localities across the country have discovered and arrested many subjects producing, trading, and consuming fake cosmetics and cosmetics imitating famous brands, causing a stir in public opinion. In particular, cosmetics such as sunscreen, shampoo, and conditioner that singer Doan Di Bang advertised widely on social networks and sold in huge quantities were also discovered to be deceiving about sun protection index and violating quality. Then, on May 29, Dong Nai Provincial Police issued a decision to prosecute the case of "Production and trading of counterfeit goods" occurring at EBC Dong Nai Medical Factory Joint Stock Company.

According to initial investigation, EBC Dong Nai Company cooperated to produce Hanayuki Sunscreen Body sunscreen product for VB Group Trading and Service Company Limited ( Ho Chi Minh City) - a company whose CEO and legal representative is Mr. Nguyen Quoc Vu, singer Doan Di Bang's husband.

Police and Market Management of Bac Giang province seized 13 different types of fake cosmetics.

According to the Drug Administration, since the beginning of May, the unit has received many requests to revoke cosmetic declaration acceptance numbers from many businesses. In one day, the Department issued 7 decisions to revoke nearly 300 acceptance numbers of imported cosmetic product declaration forms.

All 7 of these businesses have submitted documents requesting voluntary withdrawal of their registration numbers. These are registration numbers that were previously issued by the Drug Administration, allowing businesses to circulate cosmetics on the Vietnamese market.

Specifically, 7 enterprises have voluntarily withdrawn their receipt numbers, including: HSD Investment and Development Company Limited (Hung Yen) requested to withdraw 65 receipt numbers of the announcement form. Human Offshore Partners Software Services Company Limited (Ha Dong, Hanoi) requested to withdraw 14 numbers. HS Alliance Company Limited (Ha Dong, Hanoi) requested to withdraw 15 numbers. Japan Connection Investment and Trading Joint Stock Company (Ha Dong, Hanoi) requested to withdraw 78 numbers. BB Vietnam Trading and Service Company Limited (Thanh Xuan, Hanoi) requested to withdraw 60 numbers. 3M-INTEL Investment and Development Company Limited (Gia Lam, Hanoi) requested to withdraw 10 numbers and HEBE VN Company Limited (District 1, Ho Chi Minh City) requested to withdraw 52 numbers.

Most of the recalled products are related to sunscreen, shower gel, facial cleanser, some imported from Korea, Japan, France...

In particular, according to the announcement of the Drug Administration, 14 cosmetic product declaration receipt numbers of Human Offshore Partners Software Services Company Limited were recalled due to the voluntary request of the enterprise, which has many popular cosmetics on the market such as: Dove Peony & Sweet CreBody Wash shower gel (voucher number 215792/23/CBMP-QLD, issued on November 1, 2023), manufactured by Unilever Japan KK; Bioderma Sebium H2O makeup remover (voucher number 216381/23/CBMP-QLD, issued on November 8, 2023), manufactured by NAOS Les Laboratoires at 505 Rue Pierre Berthier, 13290 Aix-en-Provence, France.

According to Mr. Ta Manh Hung, Deputy Director of the Department of Drug Administration (Ministry of Health), the act of businesses voluntarily withdrawing the acceptance number for imported cosmetics is a normal activity, in accordance with current regulations.

According to statistics, in 2024, the Department revoked about 500 imported cosmetic registration numbers upon voluntary requests from businesses and more than 100 others were revoked due to violations or errors in the records.

However, recently there has been a clear increase in the number of businesses requesting to withdraw their registration numbers, and many localities have similar developments.

Many people wonder whether businesses are rushing to withdraw their cosmetic declaration forms to avoid post-audit when authorities across the country are conducting post-sales inspections, checks, and combating smuggling, trade fraud, production, and trading of counterfeit and poor-quality goods in the cosmetic group?

According to the leader of the Drug Administration Department, even if the business voluntarily withdraws the number, if the competent authority inspects and discovers that the cosmetic product has signs of violation, it can still be handled. Removing the number does not mean there is no longer a basis for handling.

Authorities will continue to closely monitor market developments and inspect cosmetics to control counterfeit, fake, and poor quality goods, especially businesses that show signs of taking advantage of withdrawing receipt numbers to avoid post-inspection or legal responsibility.
