Revenue under 100 million VND/year have to pay tax?

Many individuals with revenue under 100 million VND/year wonder whether they have to pay value added tax and personal income tax?

Clause 2, Article 4 of Circular 40/2021/TT-BTC stipulates: Business households and business individuals with revenue from production and business activities in the calendar year of VND 100 million or less are not required to pay value added tax and personal income tax according to the provisions of law on value added tax and personal income tax.

Business households and business individuals are responsible for declaring taxes accurately, honestly, and completely and submitting tax records on time; and are responsible before the law for the accuracy, honesty, and completeness of tax records as prescribed.

Thus, according to the above regulations, business households with revenue from production and business activities in the calendar year of over 100 million VND must pay value added tax and personal income tax. In particular, the tax payable will depend on each industry based on total revenue.

Specifically, online sales activities fall within the scope of distribution and supply of goods, so the personal income tax rate to be paid is 0.5% of total annual revenue. In addition, individuals and households doing online business will also have to pay 1% value added tax (VAT).

Thus, if selling on Tiktok or Facebook, the seller is obliged to pay 1.5% value added tax and personal income tax on total revenue, when selling goods with revenue of 100 million VND or more/year.

Online sellers must make personal income tax and value added tax settlements no later than the last day of the fourth month from the end of the calendar year.

In case the deadline for submitting tax settlement dossiers falls on a holiday, the deadline for submission will be calculated as the next working day of that holiday. Business people on Tiktok, Facebook in particular and online in general are obliged to declare taxes honestly, accurately, completely and pay taxes on time according to the provisions of the law (according to the provisions of the Law on Tax Administration 2019).

Regarding the administrative penalty for late tax payment, Article 13 of Decree 125/2020 of the Government stipulates that if the deadline is 1-5 days and there are mitigating circumstances, a warning will be imposed.

If the deadline is 1 - 30 days, except in the above warning cases, a fine of 2 - 5 million VND will be imposed, and a fine of 5 - 8 million VND if the deadline is 31 - 60 days.

In particular, according to Decree No. 49/2025 of the Government, from now on, if business people owe taxes of 50 million VND or more and are overdue for 120 days, they will be temporarily suspended from leaving the country.
