Speaking at the seminar, Senior Lieutenant General Tran Quang Phuong emphasized that the draft Law on Personal Data Protection is a new and difficult draft law. Personal data is both a strategic resource and a special asset, and when traded, it becomes a special commodity.
The draft law must also ensure that it meets strict requirements in the process of managing, using, and transferring personal data across borders, ensuring national security, social order and safety, unlocking resources, ensuring convenience for enterprises' production and business processes, and resolving a series of "complex relationships" because they involve many parties.
"If the draft law has inappropriate regulations, two situations will arise. One is that if the control is too tight, it will not be effective. Two is that if it is too loose, it will affect national security, social order and safety, and the legitimate rights and interests of the people...", said Vice Chairman of the National Assembly Tran Quang Phuong.

Vice Chairman of the National Assembly Tran Quang Phuong suggested that delegates focus on discussing the consistency of the draft law in the legal system; the structure of the draft law; the explanation of terms to create consistency and avoid confusion when implementing it; and the handling of violations of regulations on personal data protection.
Comrade Tran Quang Phuong gave an example of the regulation on fines of 5% of the previous year's revenue. So, what is the basis for fines for newly started businesses that have not generated revenue in the previous year, or businesses that have been operating for several years but have not yet generated revenue?
Along with that, Vice Chairman of the National Assembly Tran Quang Phuong also asked delegates to focus on giving opinions on the issue of applying the law on personal data protection; on prohibited acts; data subject rights; processing personal data without the subject's consent; on the proposal to add 3 business lines in this field to the list of conditional business lines.
Comrade Tran Quang Phuong reiterated the viewpoint of the orientation of law making, which is to ensure brevity and within the authority of the National Assembly, and not to stipulate in the law new, unclear, and unstable issues. “In particular, it is necessary to thoroughly cut and simplify administrative procedures and production and business conditions to reduce compliance costs and create the greatest convenience for people and businesses,” said Comrade Tran Quang Phuong.
The draft Law on Personal Data Protection has been carefully and meticulously researched and prepared since 2015, with many conferences, seminars and discussions organized by the drafting agency, receiving more than 700 comments from organizations and individuals. The National Assembly Standing Committee has given its opinions, the Government has accepted the opinions of the National Assembly Standing Committee, completed the draft law dossier to submit to the National Assembly for consideration and approval according to the procedure at a session.
