The Ministry of Industry and Trade issued instructions on using the agricultural product purchase list, helping businesses easily apply for C/O, removing export difficulties.

The Import-Export Department (Ministry of Industry and Trade) has issued Document No. 866/XNK-XXHH to the Vietnam Pepper and Spice Association (VPSA), providing guidance on the use of raw material purchase lists in the application for a Certificate of Origin (C/O).

For domestic raw materials without value-added invoices, enterprises can self-declare a list meeting the "WO" (wholly-originated) criteria according to the form prescribed in Appendix II, Circular 44/2023/TT-BCT, without needing confirmation from local authorities.

According to Article 15 of Decree 31/2018/ND-CP, the C/O application file does not require a certificate from the locality. However, the C/O issuing authority may conduct a physical inspection at the production facility or request additional documents such as invoices, customs declarations, sales contracts, or confirmation minutes from industry associations or cooperatives to prove the origin of raw materials. This provision creates flexibility, helping businesses meet the requirements of origin of goods.

VPSA previously proposed to remove obstacles when many localities refused to confirm the purchase list due to concerns about forgery or lack of information. The agricultural sector, with raw materials mainly from small-scale farmers who do not issue invoices, causes difficulties in applying for C/O, affecting the export of items such as pepper, coffee, and coconut.

VPSA proposed that the Ministry of Industry and Trade issue unified instructions, remove the list regulation for some key agricultural products or apply field verification, using minutes from industry organizations.

The new guidance from the Ministry of Industry and Trade is assessed by experts as timely, practical, and supportive of businesses in the context of traditional purchasing channels still being popular and farmers not issuing invoices.
