The Ministry of Education and Training has just announced a draft circular regulating the authority to recruit teachers. Accordingly, the Department of Education and Training is in charge of organizing the recruitment of teachers in educational institutions: preschools, primary schools, secondary schools, general schools with many levels of education with the highest level being secondary schools, high schools, general schools with many levels of education with the highest level being high schools, specialized schools, and continuing education institutions.

Also according to the draft, in case the provincial People's Committee chairman decentralizes teacher recruitment to other agencies or units, the decentralization must be implemented by the Department of Education and Training.
If decentralization is given to educational institutions, educational institutions from preschool to junior high school or high school principals have the right to recruit teachers and must meet the conditions for recruiting teachers according to regulations.
The draft circular also stipulates the conditions for recruiting teachers. Specifically, an educational institution is determined to meet the conditions for recruiting teachers if it simultaneously meets the following conditions: each subject in need of recruitment must ensure that there are at least 2 teachers teaching that subject and not under disciplinary action or serving a disciplinary decision.
Of which, there must be at least 1 teacher (for foreign languages, the draft stipulates at least 2 teachers) holding the title of main teacher or main lecturer who has participated in creating excellent teacher exam questions from school level or higher or has participated in creating teacher recruitment exam questions for subjects requiring teacher recruitment.
There must be a minimum number of people required to form a recruitment council as required by law.
Regarding facilities and equipment, the draft regulation must ensure adequate facilities and equipment to meet recruitment content requirements; the quarantine area must ensure facilities and equipment conditions, ensuring absolute safety and confidentiality for the exam committee and the exam committee to work.
In case of organizing the exam on computer, it is necessary to ensure enough computers for all candidates participating in the exam and enough computers for at least 1 spare exam room.
Regarding the procedure for requesting decentralization of recruitment for educational institutions, the draft clearly states that, in the first step, if an educational institution that meets the above conditions has a need to decentralize recruitment, it must send a request to the Department of Education and Training.
The application dossier includes: a request for the Department of Education and Training to appraise and submit to the Chairman of the Provincial People's Committee to delegate recruitment; evidence demonstrating the satisfaction of recruitment conditions; and a draft recruitment plan.
Step two, the Department of Education and Training reviews and advises the Chairman of the Provincial People's Committee to delegate recruitment, within 5 working days from the date of receiving the application from the educational institution.
In case the educational institution meets all the conditions for recruitment as prescribed, the Department of Education and Training shall submit to the Chairman of the Provincial People's Committee for decision on decentralization of recruitment; otherwise, the Department of Education and Training must have a written response to the educational institution.
The final step, based on the submission of the Department of Education and Training and the needs of the locality, the Chairman of the Provincial People's Committee decides whether or not to decentralize recruitment to educational institutions.
