Design documents: Does the investor have to provide an electronic copy?

According to Mr. Dung's research, the Construction Law has relevant regulations on: providing construction survey contractors with information and documents related to survey work; requesting investors and related parties to provide data and related information according to the provisions of the contract to conduct construction surveys; providing full information and documents to construction design contractors; requesting investors and related parties to provide information and documents serving construction design work.

Clause 3, Article 88 of the Law on Construction also stipulates that the establishment and storage of construction records shall be carried out in accordance with the provisions of law on archiving. According to Article 32 of the Law on Archives No. 33/2024/QH15, electronic archives include digital archives and other electronic archives.

However, the Construction Law does not specifically stipulate whether the documents must be provided in paper or digital form. When Mr. Dung's company sent a document requesting the provision of documents in digital data file form (CAD, Word, Excel...), the investor responded that it could only provide paper documents.

Mr. Dung asked, is it consistent with current legal regulations for the investor to only provide paper documents without providing digital data files?

The Ministry of Construction responded to this issue as follows:

Construction law does not have specific regulations requiring investors to provide survey and construction design documents in electronic form (such as *.dwg, *.doc, *.xls, *.pdf files, etc.).

Providing documents for construction design as stated, it is recommended to base on the signed contract agreement on providing documents for implementation.
