
Regarding the need to promulgate the Law on Digital Transformation, Deputy Minister of Science and Technology Vu Hai Quan said that the development of the Law on Digital Transformation is necessary to perfect the legal system on national digital transformation, creating an inter-sectoral legal system on digital transformation in industries and fields. The Law regulates the relationship between entities participating in activities in the digital environment; promotes the comprehensive digital transformation process; strengthens international cooperation and integration.

The draft Law on Digital Transformation consists of 8 chapters and 79 articles, regulating digital transformation, including: infrastructure for digital transformation; digital government and digital transformation of activities of agencies in the political system; digital economy; digital society and measures to ensure digital transformation. This law applies to Vietnamese agencies, organizations and individuals, foreign organizations and individuals directly participating in or having activities related to digital transformation in Vietnam.
At the workshop, delegates highly agreed on the necessity of promulgating the Law on Digital Transformation, considering this an important step to institutionalize Resolution 57-NQ/TW (2024) and Resolution 22-NQ/TW (2025) of the Politburo, meeting urgent requirements in building a digital government, digital economy and digital society. Many opinions suggested continuing to perfect regulations, overcoming overlaps and supplementing enforcement mechanisms suitable to practice, especially contents related to technology application, management and budget allocation for digital transformation.
Regarding the regulation on technology development for digital transformation (Article 43), Mr. Tang Ly Quang Huy - Deputy Head of Policy Department, Bidding Management Department (Ministry of Finance) said that the draft is simultaneously using the two concepts of "priority" and "incentive", while the bidding law only stipulates incentives. Therefore, it is necessary to clarify the difference to ensure feasibility when applying. This opinion also emphasizes that state agencies and state-owned enterprises need to prioritize renting and purchasing digital technology products and services produced in Vietnam, except for cases under international commitments.
Contributing to the content of contractor selection and promoting the technology market, Mr. Nguyen Tu Quang, Chairman of the Board of Directors, General Director of BKAV said that currently, the bidding for information technology still has many shortcomings. The selection of contractors is often based on closed relationships instead of actual capacity. The state of legalizing the process and the lack of real competition leads to the budget being spent but not necessarily receiving the most optimal product.
Mr. Nguyen Tu Quang said that it is necessary to perfect the system of standards and regulations to evaluate bids quantitatively, and at the same time prioritize the application of the "one-stage, two-envelope" method, evaluating the technique and quality before considering the price to avoid the situation of "cheap price but outdated technology". He also proposed to establish a random Bid Evaluation Council, announced close to the time of bid opening to ensure objectivity and prevent collusion.

Regarding support for small and medium-sized enterprises, Mr. Nguyen Tu Quang commented that although this group of enterprises accounts for a large number, it is still weak in technology bidding due to the lack of effective market protection tools. Current preferential regulations have not created clear changes, while large enterprises still compete even for small-scale bids. Mr. Nguyen Tu Quang proposed to stipulate a "hard limit" (a certain percentage of the budget) in digital transformation projects that must be reserved for small and medium-sized enterprises. In addition, there should be a monitoring mechanism to prevent large enterprises from circumventing the law to compete for market share from small and medium-sized enterprises.
National Assembly Deputy Nguyen Tuan Thinh (Hanoi Delegation) said that budget allocation for digital transformation needs to be carefully reviewed to avoid spreading. Tasks that can mobilize social resources must be clearly defined in the draft Law. He also suggested that the Ministry of Science and Technology be assigned to provide specific guidance on functions and tasks related to digital transformation so that agencies and units can easily implement them, avoiding overlap between ministries and branches.
Representing the Ministry of Science and Technology, Mr. Nguyen Ngoc Hai - Deputy Director of the Department of Financial Planning emphasized the need to promulgate the Law on Digital Transformation, and acknowledged the comments at the Workshop. Mr. Nguyen Ngoc Hai said that the Ministry will direct the units to fully absorb the draft Law dossier, report to the Committee on Science, Technology and Environment to submit to the National Assembly.

He requested the Ministry of Science and Technology to direct the National Digital Transformation Agency to coordinate with relevant units to complete the draft Law dossier and report to the Committee to submit to the 15th National Assembly for consideration at the 10th Session.
