The Prime Minister issued the Plan to implement the Law on Prices No. 16/2023/QH15
The plan aims to organize the implementation of the Law on Prices in a timely, synchronous, unified and effective manner. It identifies the work contents, completion deadlines and responsibilities of relevant agencies and organizations in organizing the implementation of the Law.
Propaganda and dissemination in appropriate forms
According to the Plan, in 2023 and 2024, propaganda, dissemination and training on the contents of the Law will be organized to the subjects in appropriate forms.
The Prime Minister requested the Ministry of Finance to preside over the organization of conferences to disseminate, popularize and train the contents of the Law on Prices for ministries, branches, localities, agencies, organizations and price appraisal enterprises. At the same time, promote the dissemination of the Law in other forms such as posting the Law and documents to disseminate the Law on the Electronic Information Portal/Page, the National Database of Legal Documents; coordinate with Vietnam Television, Voice of Vietnam, Vietnam News Agency, Nhan Dan Newspaper, information agencies and press to increase the time, integrate and widely disseminate the new contents of the Law regularly.
The Ministry of Finance compiles documents to serve the work of propaganda, dissemination and training on the Law; proactively speeds up the progress of drafting documents detailing the implementation of the Law, documents guiding implementation to organize propaganda, dissemination and widely collect opinions from agencies and subjects implementing the Law.
Ministries, ministerial-level agencies, government agencies, central agencies and organizations (ministries, branches) and People's Committees of provinces and centrally run cities (localities) shall proactively organize and disseminate the Law to cadres and civil servants of their agencies and units through appropriate forms.
The Prime Minister requested the Central Committee of the Vietnam Fatherland Front, Central Agencies of socio-political organizations, the Vietnam Lawyers Association, and the Vietnam Bar Federation to direct and organize propaganda and dissemination to members of their organizations and participate in disseminating legal education to the people in appropriate forms.
In addition, it will organize a review of current legal documents on prices to propose amendments, supplements, repeals or new issuances in accordance with the provisions of the Law on Prices. The Prime Minister requested ministries, branches and localities to base on the List of Documents and the Law on Prices to organize the review of legal documents; based on the review results, proactively amend, supplement, replace, repeal or issue new ones according to their authority or submit to competent authorities according to regulations, ensuring that the documents take effect at the same time as the Law. In particular, for goods and services newly added to the list; goods and services with changed authority and form of pricing, it is necessary to be proactive in formulating price plans and appraising price plans to have a basis for issuing timely price decision documents, ensuring quality.
Based on the implementation results, ministries, branches and localities shall submit a summary report with a list of documents to the Ministry of Finance before May 5, 2024.
Strengthening and perfecting the team of price appraisers
According to the Plan, legal documents will be developed and issued to detail and guide the implementation of the Law on Prices.
At the same time, strengthen and perfect the team of price appraisers, price appraisal enterprises and Price Appraisal Councils to meet the regulations on price appraisal activities in the Law on Prices; improve the quality of price appraisal service provision and price appraisal activities of the State.
Specifically, review and evaluate price appraisers practicing at price appraisal enterprises to develop a plan to enhance training and organize exams to issue price appraiser certificates to ensure compliance with practical requirements and regulations in the Law on Prices. The Ministry of Finance, price appraisal enterprises, price appraisal training institutions and price appraisers shall organize the implementation. To be completed before July 1, 2025.
Focus from October 2023 to December 31, 2025 and the following years, improve professional capacity in price appraisal for cadres, civil servants, public employees and workers to meet the requirements when participating in the Price Appraisal Council at ministries, branches and localities as prescribed in Section 3, Chapter VI of the Law on Prices; ensure to meet the requirements of state price appraisal at agencies and units when arising.
The Prime Minister requested ministries, branches and localities to organize assessments of the need to conduct State valuation at agencies and units; review the professional capacity of valuation of cadres, civil servants, public employees and workers at agencies and units who have been trained and granted State valuation training certificates. On that basis, proactively develop plans and coordinate with the Ministry of Finance to organize training courses on State valuation.
The Ministry of Finance shall proactively or coordinate with ministries, branches and localities to organize training courses on State valuation according to its functions, tasks and legal regulations.
Implement well the regulations on public disclosure of price information and price appraisal.
The Prime Minister requested to review, consolidate and prepare conditions to ensure good implementation of regulations on public disclosure of price information and price appraisal as prescribed in Article 6 of the Law on Prices.
The Ministry of Finance proactively speeds up the construction and operation of the National Price Database to ensure the reception, updating and disclosure of price information in accordance with current regulations and the provisions of the 2023 Price Law.
Ministries, sectors, localities, and price appraisal enterprises are responsible for fully updating price data information into the National Price Database. Localities, based on the provisions of Clause 3, Article 38 of the Law on Prices and the actual situation in the locality, shall proactively build a local price database (if any) and must ensure connection with the National Price Database.
Ministries, branches, localities, price appraisal enterprises; organizations and individuals trading in goods and services shall review and complete the electronic information pages of agencies and units (if any) to ensure that they meet the requirements for public disclosure of price information; prepare conditions to ensure the public disclosure of price information and price appraisal in accordance with the provisions of Article 6 of the Law on Prices and publicly post information on the list of price appraisers and price appraisal enterprises qualified to conduct price appraisal services, information on handling of administrative violations related to prices and price appraisal in accordance with the provisions of Article 72 of the Law on Prices.
Completion date is before July 1, 2024.
In addition, strengthen coordination between ministries, branches and localities to improve the quality of activities of synthesizing, analyzing and forecasting market prices; in performing tasks of price management, operation and price appraisal within the authority, functions and tasks assigned according to the provisions of Chapter V of the Law on Prices and other relevant legal provisions.
The Prime Minister requested the Minister of Finance to be responsible for monitoring, urging, and guiding relevant ministries, branches, localities, agencies, and organizations in implementing the tasks stated in the Plan on schedule.
