On the morning of October 16, the National Assembly Standing Committee gave its opinion on the draft Law on Digital Transformation. The draft law will be submitted to the upcoming 10th session of the National Assembly.

Proposing new regulations for providing public services

Notably, the bill specifically regulates the provision of public services. It clearly stipulates that state agencies provide online public services at two levels: full and partial.

The bill stipulates that the State is responsible for ensuring that all citizens, regardless of age, gender, education level, socio -economic status, geographical conditions or physical abilities, have equal opportunities to access and use online public services.

The online public service system must comply with international standards, including user-friendly interfaces, multilingual support, including sign language and other forms of assistance for people with disabilities.

Accessibility must be compatible with a wide range of devices (computers, smartphones, specialized devices for the disabled). The system also needs to have tools to support access in remote, isolated, and particularly difficult areas.

The bill states that online public services are designed and provided according to people's life events and business life cycles, aiming at personalization to suit the specific needs of each individual and organization.

State agencies are responsible for coordinating and connecting to provide online Public Services in a series of events, instead of fragmenting according to the administrative authority of each agency.

The principle is that people and businesses only have to provide information once. The processing procedure is continuous, seamless, and has no administrative boundaries. The time and cost of performing administrative procedures are minimized.

The draft stipulates the legal responsibility of state agencies in data exploitation and is not required to resubmit documents.

Accordingly, organizations and individuals must not be required to resubmit documents and information already in these databases, unless otherwise provided by law.

At the same time, it clearly stipulates how to handle cases where state agencies violate the above regulations. Accordingly, the head of the agency or unit that allows violations to occur must be accountable and administratively responsible according to the provisions of the law on cadres, civil servants and public employees.

Violating agencies and units will be handled according to the provisions of the law on administrative discipline, and at the same time, information about the violation will be made public on the National Public Service Portal.

In case of causing damage to organizations or individuals, the violating agency is responsible for compensation according to regulations.

Make sure no one is left behind

Deputy Minister of Science and Technology Vu Hai Quan said the bill has codified the principles of digital transformation, requiring state agencies to comply in all activities. Such as putting people and users at the center; digital from the beginning; data-based management.

The Committee on Science, Technology and Environment proposed to consider regulating that online public services be designed and provided according to people's life events and business life cycles, aiming at personalization to suit the specific needs of each individual and organization.

The examining agency believes that the administrative procedure has clearly defined the order, implementation method and competent authority to handle it, ensuring equal rights of subjects performing administrative procedures according to the provisions of law.

Provisions as in the draft law may lead to arbitrariness and inconsistency in the implementation of administrative procedures between different agencies in the state administrative apparatus.

Chairman of the Law and Justice Committee Hoang Thanh Tung stated that providing online public services by state agencies is necessary.

However, it should be noted that accelerating digital transformation without ensuring infrastructure and human resources conditions will lead to problems that may impact the implementation of administrative procedures and the provision of public services to people.
