The People's Committee of Hoa Binh province has just issued Directive No. 03/CT-UBND on rectifying the inspection and examination of enterprises in the province. The content of the document shows: "In order to overcome and rectify the situation in the inspection and examination of enterprises, create favorable conditions for enterprises to perform well in production and business activities, and at the same time improve the investment and business environment of the province, the Chairman of the Provincial People's Committee requests the Heads of departments, branches, sectors and Chairmen of People's Committees of districts and cities; Legal representatives of enterprises and heads of relevant agencies and organizations to strictly implement the following contents:
For heads of departments, branches and sectors; Chairmen of People's Committees of districts and cities: "Directly direct the development and implementation of inspection and examination plans in accordance with approved contents, avoiding duplication and overlap in inspection and examination of enterprises...; Send inspection and examination decisions to the Provincial Inspectorate after 05 days of implementing the inspection and examination for monitoring, reviewing and handling duplication; when adjusting or supplementing the inspection plan, a written document must be sent to the Provincial Inspectorate for consideration and handling and comments before adjusting or supplementing the inspection plan. During the inspection and examination process, it is necessary to comply with legal provisions on the content, procedures and time limit for conducting inspections, not causing inconvenience or affecting the normal production and business activities of enterprises...

The People's Committee of Hoa Binh province directed not to allow many inspection teams from departments, branches, and People's Committees of districts and cities to conduct inspections at one enterprise in one year.
Do not conduct more than one inspection or examination at an enterprise in a year (except in cases of re-inspection or enterprises showing signs of violating the law and inspection according to regulations on the implementation of inspection conclusions). When completing an inspection or examination at an enterprise, there must be a written record or conclusion of the inspection or examination on the content that has been inspected or examined. Do not allow multiple inspection or examination teams of departments, branches, and People's Committees of districts and cities to conduct inspections at an enterprise in a year.
For enterprises that need to inspect and examine many fields and contents related to the management responsibilities of many agencies and units, they must coordinate to advise and report to the Provincial People's Committee to establish an interdisciplinary team to reduce the number of inspections and examinations; Avoid multiple teams inspecting and examining the same enterprise in the same year.
Unscheduled inspections and examinations at enterprises shall only be conducted when there are clear signs of violations of the law or upon request of handling complaints and denunciations, preventing and combating corruption and negativity, or as assigned by the Head of a competent State management agency. The agency conducting unscheduled inspections and examinations at enterprises must issue an inspection and examination decision and implement it in accordance with the provisions of law, and must report to the Head of the same level and the Provincial Inspectorate for information and direction. The scope of inspection and examination shall not be arbitrarily expanded beyond the content of the unscheduled inspection and examination decision; the conclusion of the inspection and examination must clearly identify the nature and extent of the violation.
Provincial police must be responsible for overlapping and duplication of inspections of the forces under their direct charge.
For the Provincial Police, Directive No. 03/CT-UBND requests: The Provincial Police directs its subordinate units to properly perform the assigned functions and tasks according to the provisions of law. Direct inspections and examinations at enterprises are only conducted according to programs and plans or when detecting signs of violations of the law in the field of State management of security, order, and social safety or when there is a report of a crime related to the enterprise and there must be a written decision to inspect and examine by a competent person; Do not criminalize economic and civil relations; and at the same time, be responsible for overlapping and duplicate inspections of the force under their direct charge.
Referring to the Central agencies located in the area (Provincial Tax Department, Provincial Social Insurance, Provincial State Treasury, Provincial State Bank Branch...), Directive No. 03/CT-UBND requests the units to: "Be responsible for coordinating inspection and examination activities on finance, tax, social insurance; coordinate with departments, branches, and localities to develop programs and plans for inspection and examination of enterprises, avoiding duplication and overlap right from the time of developing programs and plans; send annual inspection and examination plans to the Provincial Inspectorate for coordination, review and handling of duplication...

The Provincial Inspectorate shall preside over the review and unification of inspection and examination plans throughout the province; promptly detect and handle overlaps and duplications in scope, subjects, contents and time of inspections according to its authority; propose handling of responsibilities for agencies, units and individuals causing duplication and overlaps; preside over and advise the Provincial People's Committee to establish an interdisciplinary team in case of inspection and examination of many fields and contents at an enterprise.
