Clarifying the mechanism for decentralizing the national database system on technical standards and regulations

Ensuring transparency and avoiding abuse of power in "conformity assessment"

The majority of National Assembly deputies agreed to amend and supplement a number of articles of the Law on Technical Standards and Regulations to institutionalize the Party's guidelines and policies, the State's laws and policies to perfect the legal system on technical standards and regulations. At the same time, perfect the legal framework on technical standards and regulations to improve the effectiveness of state management, ensure the feasibility and consistency of the relevant legal system; and internalize international commitments in the next generation of free trade agreements (FTAs).

The Draft Law has added the definition of: “Conformity assessment is the determination of the subjects of activities in the field of standards and the subjects of activities in the field of technical regulations in accordance with the technical characteristics and management requirements specified in the corresponding standards and technical regulations. Conformity assessment includes the activities: testing; calibration; inspection; verification…”.

National Assembly Deputy Nguyen Tam Hung (Ba Ria - Vung Tau) said that this is a necessary addition in current practice. Because "conformity assessment" is becoming an important factor in ensuring that products, goods and services meet legal requirements on safety and quality.

However, delegate Nguyen Tam Hung suggested that the Drafting Committee consider adding clearer regulations on the responsibilities and powers of organizations implementing "Conformity Assessment".

Accordingly, these organizations must be responsible for periodically reporting on their activities and be subject to supervision by competent state agencies to ensure transparency and avoid abuse of power. In particular, there should be regulations on handling violations if these organizations provide inaccurate or non-objective assessment results.

Create conditions for organizations and individuals to have better access to technical standards and regulations.

Regarding the national database system, many opinions say that adding regulations on the national database system on technical standards and regulations is the legal basis for building, updating, and managing the national database system on unified technical standards and regulations from the central to local levels.

Thereby, creating conditions for organizations and individuals to have better access to technical standards and regulations, as well as defining the responsibilities of relevant parties in building, updating, managing and maintaining the system.

According to National Assembly Delegate Trieu Thi Ngoc Diem (Nghe An), the establishment of a national database system on technical standards and regulations will bring many benefits to businesses and state management agencies, such as: saving costs in searching for information; increasing transparency and reliability of products on the market.

However, National Assembly Deputy Tran Van Tien (Vinh Phuc) suggested that the drafting agency study and perfect the data exploitation mechanism and the decentralization mechanism in building, exploiting and using the national database system.

At the same time, supplement and clarify the decentralization of management to ministries, branches and localities to reduce the burden on the Ministry of Science and Technology, as well as promote the available resources of ministries, branches and localities. At the same time, clearly demonstrate the role of chairing and coordinating the construction, exploitation and use of the database on technical standards and regulations of the Ministry of Science and Technology. Clarify the regulations on connecting the database system of technical standards and regulations between ministries so that organizations, individuals and enterprises do not have to register, notify and publish in many places for products, goods and services that are jointly managed by many ministries.
