Codify many specific regulations to increase legal strength for accountability activities.

On the afternoon of August 6, at the National Assembly's Forum on supervision activities, Dr. Nguyen Dinh Quyen, former Deputy Chairman of the National Assembly's Judiciary Committee, made nine specific recommendations to increase the legal strength of accountability activities.

With 30 years of experience in the field of law-making, including two terms as a National Assembly delegate, Mr. Nguyen Dinh Quyen expressed special interest in accountability activities.

According to the delegate, accountability activities in other countries are one of the indispensable elements of the rule of law state, quite similar to hearing activities. Because we do not have much experience, this activity has also been added to the law not long ago, lacking specific regulations, so the implementation in practice is inconsistent and not very effective.

To contribute to the innovation of this activity, Mr. Nguyen Dinh Quyen suggested that the organization of the explanation session and the selection of explanation issues should not only depend on the subjective awareness of these agencies but also must meet the objective and inevitable requirements of life, especially the pressing issues that are being raised. The Law on Supervision Activities of the National Assembly and People's Councils needs to supplement the regulation: in specific cases, when all factors and criteria are met, the agencies of the National Assembly need to organize explanation activities.

To improve the effectiveness and efficiency of accountability activities, it is necessary to innovate the preparation work - which largely determines the success or failure of accountability activities; it is necessary to approach, collect information, and request information through many channels (from reports of the Government , of relevant agencies, from handling complaints and denunciations, thematic supervision, supervision of the People's Council or the Fatherland Front...) as a basis for asking critical questions, dialogue and debate to serve the accountability session.

According to Mr. Nguyen Dinh Quyen, it is necessary to specify more specifically the procedural order, scope of basic contents, methods of implementation and responsibilities of the parties and legal consequences of the accountability activities; especially the responsibilities of the accountability agency, first of all the responsibility to report promptly, honestly and fully the contents as required by the accountability agency, especially issues of limitations, shortcomings and causes.

“When amending the Law on Supervision Activities of the National Assembly and People's Councils, it is necessary to add criteria to determine the topic, ensuring focus and key points. Accountability activities must be linked with other supervisory methods, especially the supervisory method of handling complaints and denunciations of citizens. In particular, it is necessary to add the principle of equality and democracy in the process of explanation,” Mr. Nguyen Dinh Quyen emphasized. According to this expert, the subject of explanation should not be considered as one's subordinates. The parties performing their functions and tasks according to the law must be equal and democratic in the process of explaining and responding to explanations.

It is necessary to promote the role of mass media to fully and honestly convey the content of the explanation so that people have the conditions to supervise the activities of the agencies that must explain.
