The training program "Long-term business - Starting from the law" is organized by the Center for E-commerce and Digital Technology Development (eComDX), the Department of E-commerce and Digital Economy (Ministry of Industry and Trade) in coordination with other organizations with the aim of raising awareness and capacity to comply with the law in the digital environment for businesses.

At the event, Mr. Nguyen Huu Tuan, Director of the Center for E-commerce and Digital Technology Development (eComDX), Department of E-commerce and Digital Economy ( Ministry of Industry and Trade ) provided an overview of the current legal framework and conditions for e-commerce business.

Accordingly, the guiding Decrees, Circulars and related laws such as the Law on Electronic Transactions 2023, the Commercial Law, the Law on Protection of Consumer Rights, have created a fairly complete legal corridor, regulating everything from notification and website registration to issues of electronic contracts, payment or dispute resolution.

The training program with the theme "Long-term business - Starting from the law" took place on the afternoon of June 25, 2025, in Hanoi with the participation of businesses and sellers on e-commerce platforms.

Information businesses need to note when doing business in the e-commerce environment

According to Mr. Nguyen Huu Tuan, to do business on e-commerce platforms, sellers and e-commerce platforms need to strictly comply with regulations to ensure a healthy business environment.

For sellers , the prerequisite is to have clear legal status, provide accurate information about themselves and their goods and services, and publicize sales policies such as returns and warranties. In particular, it is mandatory to notify or register the website/e-commerce application with the Ministry of Industry and Trade.

For e-commerce trading floors , the responsibility is even heavier. Floors must register with the Ministry of Industry and Trade, develop transparent operating regulations, establish information control mechanisms and support dispute resolution. Floors also need to require sellers to provide full legal information and coordinate closely with state management agencies in preventing counterfeit and fake goods.

The Director of the Center for E-commerce and Digital Technology Development further emphasized the responsibilities of each entity. Specifically, the seller is primarily responsible for the quality of goods and services, the accuracy of product information, the fulfillment of sales commitments, and the protection of buyers' personal information. The e-commerce platform acts as an intermediary, responsible for ensuring a safe and reliable trading environment. The platform must control information, prevent violations of the law on its platform, support the resolution of complaints, and provide necessary information to state management agencies when requested. In particular, the responsibility for joint compensation for damages in some cases if management obligations are not properly performed is being carefully considered in the process of drafting the new law.

Rights and obligations of sellers and e-commerce platforms

To maintain market discipline, Mr. Nguyen Huu Tuan also reviewed prohibited behaviors and corresponding sanctions. "Behaviors such as not notifying/registering websites, trading in counterfeit, banned, or fake goods, false advertising, tax fraud, infringement of personal information, or cyber attacks are strictly prohibited," Mr. Tuan affirmed.

Regarding sanctions, depending on the severity of the violation, entities may be subject to administrative sanctions (fines, confiscation of exhibits, suspension of operations, revocation of licenses) according to specialized Decrees. "For more serious cases with major consequences, violations may be prosecuted under the Penal Code. In addition, compensation for civil damages is also an important sanction to protect the rights of related parties," Mr. Tuan added.

Accompanying sellers in the digital environment, Mr. Nguyen Lam Thanh, representative of TikTok Vietnam, shared that the training program 'Long-term business - Starting from the law' is TikTok Shop's commitment to contributing to the sustainable development of e-commerce in Vietnam, demonstrated through programs accompanying state management agencies to equip sellers and content creators with solid legal knowledge, to work with the Ministry of Industry and Trade to create a digital generation that is both creative and legally knowledgeable, building a professional and trustworthy e-commerce ecosystem, which is the basis for consumers to shop with peace of mind.
