Resolution on the draft amendment of the Environmental Police Ordinance

Specifically, the Government basically agrees with the draft Ordinance amending and supplementing a number of articles of the Ordinance on Environmental Police submitted by the Ministry of Public Security. The Government assigned the Ministry of Public Security to preside over and coordinate with ministries, ministerial-level agencies and relevant agencies to study and absorb the maximum opinions of Government members.

The Ministry of Public Security is fully responsible for the contents of receiving and explaining the opinions of Government members, promptly completing the draft documents of the Ordinance in accordance with regulations, ensuring the following requirements:

Thoroughly grasp and fully institutionalize the viewpoints, guidelines and policies of the Party and State on the arrangement and streamlining of the State apparatus. Ensure compliance with the Constitution and consistency in the legal system, newly issued relevant legal documents; in accordance with the provisions of relevant international treaties to which Vietnam is a member. Ensure the feasibility of regulations, meeting the requirements of Vietnam's integration with countries in the region and the world .

Carefully review the contents of the draft Ordinance, ensure that the amended contents are appropriate and consistent with the provisions of the law on the organization of the People's Public Security apparatus, closely follow the practical work of fighting and preventing environmental crimes to maintain the stability of the regulations; minimize administrative procedures, create favorable and transparent conditions, remove difficulties and obstacles in the work of fighting and preventing environmental crimes. Strengthen control of power, prevent and combat corruption, negativity, group interests, and localism in the work of law-making.

Continue to coordinate with relevant ministries, branches and agencies and consult with experts and practitioners to complete the Ordinance project dossier to ensure clarity, transparency, feasibility and consistency during implementation.

The Government assigned the Minister of Public Security, authorized by the Prime Minister, to sign on behalf of the Government the Government's Submission on the draft Ordinance amending and supplementing a number of articles of the Ordinance on Environmental Police, to submit to the National Assembly Standing Committee, ensuring the prescribed deadline.

The Government assigned Permanent Deputy Prime Minister Nguyen Hoa Binh to direct the Ministry of Public Security and relevant ministries and agencies in the process of revising and completing this Ordinance project.

Amending the Environmental Police Ordinance is extremely urgent.

The Environmental Police Ordinance issued by the National Assembly Standing Committee on December 23, 2014 is a solid legal basis, creating conditions for the establishment of specialized forces (Environmental Crime Prevention and Control Police) at 3 levels: Ministry, province, and district.

Implementing Project No. 19/DA-BCA of the Ministry of Public Security on perfecting the organizational apparatus and the policy of reorganizing the local government at two levels, eliminating the district-level police, has created fundamental changes. The model of local police organization has shifted towards "comprehensive province, strong commune, close to the grassroots".

Therefore, it is extremely urgent to promptly amend and supplement the Environmental Police Ordinance so that the regulations related to the organization and apparatus of the Environmental Crime Prevention and Control Police force must be consistent with the new organizational model. This is to ensure that the fight against environmental crimes is carried out continuously, without interruption and with strong effectiveness right from the grassroots level.
