Many important laws come into effect from July 1, 2025

The laws that will take effect from July 1 include: Law amending and supplementing a number of articles of the Law on Health Insurance; Law on Social Insurance 2024; Law on Trade Unions 2024; Law on Value Added Tax 2024; Law on Pharmacy 2024; Law on Notarization 2024; Law on Archives 2024; Law on Geology and Minerals 2024; Law on Cultural Heritage 2024; Law on Urban and Rural Planning 2024; Law on Data 2024; Law on Fire Prevention, Fire Fighting and Rescue 2024; Law on People's Air Defense 2024; Law on Defense Industry, Security and Industrial Mobilization 2024; Law on Prevention and Combat of Human Trafficking 2024.

Improve social security, health, union and tax policies

The Law amending and supplementing a number of articles of the Law on Health Insurance has 8 new groups of points related to amending and updating the subjects of participation; regulations on medical examination and treatment under health insurance; regulations on health insurance benefits when implementing the provision of medical examination and treatment under health insurance according to the guidance regardless of administrative boundaries by province, maintaining the rate of health insurance benefits according to the provisions of the current Law and expanding it to a number of cases. In addition, the Law adjusts the rate of expenditure for medical examination and treatment under health insurance, reserve expenditure and organization of health insurance activities from the amount of health insurance contributions; supplements the mechanism for payment of drugs and medical equipment transferred between medical examination and treatment facilities and payment of paraclinical service costs transferred to other facilities in case of shortage of drugs and medical equipment and stipulates the mechanism for the health insurance fund to pay for these cases...

The Law on Social Insurance consists of 11 chapters and 141 articles. Notably, the Law has been amended and supplemented in the direction of increasing benefits, increasing attractiveness, and encouraging employees to reserve their contribution period to receive pensions instead of receiving social insurance in one lump sum. Employees who have stopped participating in social insurance but have a request will receive social insurance in one lump sum if they fall into one of the following cases: Being of retirement age but have not paid social insurance for 15 years; going abroad to settle down; people suffering from one of the following diseases: cancer, paralysis, decompensated cirrhosis, severe tuberculosis, AIDS; people with a working capacity reduction of 81% or more; people with extremely severe disabilities; employees who have paid social insurance before July 1, 2025, after 12 months are not subject to compulsory social insurance but do not participate; voluntary social insurance and have paid social insurance for less than 20 years.

The 2024 Trade Union Law consists of 6 chapters and 37 articles. Ensuring trade union finances is one of the notable contents of the Law. Accordingly, the Law maintains the regulation that agencies, organizations, units, enterprises, cooperatives, and cooperative unions of all economic sectors, regardless of whether a trade union has been established or not, must pay trade union fees equal to 2% of the salary fund, which is the basis for paying compulsory social insurance for employees.

Also effective from July 1, the Law on Value Added Tax consists of 4 chapters and 18 articles. Notably, the Law supplements the provisions that exported goods and services are goods and services directly supplied to organizations and individuals abroad and consumed outside Vietnam or directly supplied to organizations in duty-free zones and consumed in duty-free zones to directly serve export production activities. Digital information content products provided to foreign parties and with records and documents proving consumption outside Vietnam according to Government regulations are also subject to a 0% tax rate. The amended Law stipulates: Fertilizers, fishing vessels in coastal areas; specialized machinery and equipment serving agricultural production according to Government regulations; traditional and folk performing arts activities are subject to a 5% tax rate...

The Law amending and supplementing a number of articles of the Law on Pharmacy (Law on Pharmacy 2024) consists of 3 articles. The Law has a number of new points related to state policies on pharmaceuticals and promoting the development of the pharmaceutical industry; diversifying the system and methods of trading and distributing drugs and pharmaceutical ingredients; reducing and simplifying a number of business conditions and administrative procedures; strengthening decentralization and delegation of authority; managing the export and import of drugs and pharmaceutical ingredients in accordance with international practices and practices... The Law was promulgated to promptly remove difficulties and obstacles in institutional and legal aspects in drug management activities, including ensuring drugs for disease prevention and control and urgent cases arising in practice, continuing to reform administrative procedures in pharmaceutical activities, ensuring increased access to drugs for people...

Creating change in management and sustainable development

Effective from July 1, the 2024 Notary Law consists of 8 chapters and 76 articles. The Law has a number of new contents related to determining the correct scope of notarization and the authority of notaries, regulations on transactions that must be notarized; amending and supplementing a number of regulations on: notaries, notary practice organizations, notary practice, notary transaction notarization procedures, notary database, notary record storage; new regulations on state management in notarization and administrative procedures in the field of notarization.

Similarly, the 2024 Law on Archives consists of 3 chapters and 65 articles; it was developed to institutionalize the Party's policy at the 13th National Congress on the legal system promoting innovation, digital transformation and developing products and services in the field of archives to arouse the aspiration for a prosperous and happy country, promote cultural values, and the strength of the Vietnamese people in the cause of national construction and defense, and international integration. The Law focuses on clarifying 4 major policies: Authority to manage archival documents belonging to the National Archives of Vietnam; management of electronic archival documents to meet the requirements of digital transformation and e-Government development; management of private archival documents; management of archival service activities.

The Law on Geology and Minerals 2024 is built focusing on 5 key policies. These are policies on geological and mineral resources, basic geological surveys, geological surveys of minerals, geological and mineral information and data; perfecting policies on the protection of geological and mineral resources, strategies and planning of geology and minerals; perfecting policies on mineral areas; management of mineral exploration and exploitation activities; geology and minerals.

The 2024 Law on Cultural Heritage consists of 9 chapters and 95 articles. One of the important breakthroughs of the Law is to expand regulations related to promoting the value of cultural heritage, exploiting and using heritage, promoting public-private cooperation and establishing a Cultural Heritage Conservation Fund; at the same time, there are regulations related to digital transformation, digitization of cultural heritage and promoting the value of cultural heritage in the electronic environment.

The Law on Urban and Rural Planning consists of 5 chapters and 59 articles; it covers and specifies 3 basic policy contents. That is to complete the regulations on: urban and rural planning system; establishment, appraisal, approval, review, adjustment of urban and rural planning; selection of planning consultancy organizations, funding sources and other relevant regulations to improve the quality and feasibility of urban and rural planning, the right to access and provide information on urban and rural planning.

Creating an important legal corridor in the data sector

The 2024 Data Law has 5 chapters and 46 articles. One of the important contents of the Data Law is the regulation on the establishment of a National General Database. Accordingly, the National General Database is established to serve the exploitation and common use, meeting the activities of Party and State agencies, the Vietnam Fatherland Front Committee and socio-political organizations; serving the implementation of administrative procedures, public services, serving the direction and administration of the Government; serving the work of statistics, policy making, planning, socio-economic development strategies, national defense, security, foreign affairs, cryptography, crime prevention and control, handling of law violations; serving the needs of organizations and individuals in exploiting, using and applying data.

The 2024 Law on Fire Prevention, Fire Fighting and Rescue consists of 8 chapters and 55 articles. Notably, regarding fire prevention and fighting inspections, the Law stipulates that heads of establishments, household owners, vehicle owners, and investors shall organize their own inspections to promptly detect loopholes and safety risks that can easily cause fires and explosions at establishments, households, and vehicles under their management. In addition, within the scope of their duties and powers, the People's Committees at the commune level, the Public Security agencies, specialized construction agencies, and inspection agencies shall conduct fire prevention and fighting inspections in accordance with the provisions of law. The Law has removed fire prevention regulations for 11 types of establishments currently regulated in the current Law on Fire Prevention and Fighting because these establishments all have specialized regulations and standards guiding regulations on fire prevention and fighting safety...

The 2024 Law on People's Air Defense consists of 7 chapters and 47 articles; creating a common legal framework for the establishment, mobilization, and organization of people's air defense activities; managing activities related to unmanned aircraft, other flying vehicles, and ensuring air defense safety, improving the legal effectiveness of the legal system on people's air defense. At the same time, it contributes to building a comprehensive and strong national defense, promoting the country's combined strength to firmly protect the airspace of the Fatherland of Vietnam, maintaining a peaceful environment, political stability, order, and social security for socio-economic development.

The Law on National Defense, Security and Industrial Mobilization Industry 2024 consists of 7 chapters and 86 articles; stipulating the position, tasks, principles, organization, operation, resources, regimes, policies; responsibilities of agencies, organizations and individuals regarding the national defense, security and industrial mobilization industry. The Law stipulates the principles of building and developing the national defense, security and industrial mobilization industry as follows: Under the absolute and direct leadership in all aspects of the Communist Party of Vietnam, the unified management of the State; complying with the Constitution and laws of Vietnam, international treaties to which the Socialist Republic of Vietnam is a member.

Also effective from July 1, the Law on Prevention and Combat of Human Trafficking 2024 consists of 8 chapters and 63 articles. The law was developed to improve the law on prevention and combat of human trafficking, create a unified and comprehensive awareness of the work of prevention and combat of human trafficking in the coming time; enhance the responsibility of individuals, families, agencies, organizations and the whole society in the work of prevention and combat of human trafficking. At the same time, perfect the legal basis for supporting and protecting the legitimate rights and interests of victims and those in the process of being identified as victims in accordance with the current and future socio-economic situation, contributing to stabilizing the security, order and social safety situation; improve the effectiveness of state management of prevention and combat of human trafficking.

Recently, after 35 working days, the 9th Session of the 15th National Assembly voted to pass a number of Laws such as: Law amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Implementing Democracy at Grassroots Level; Law amending and supplementing a number of articles of the Law on National Defense, the Law on People's Army Officers, the Law on Professional Soldiers, Workers and Defense Officials, the Law on Military Service, the Law on Vietnam Border Guard, the Law on People's Air Defense, the Law on Reserve Forces, the Law on Civil Defense, the Law on Management and Protection of National Defense Works and Military Zones, the Law on Militia and Self-Defense Forces, the Law on National Defense and Security Education; Law amending and supplementing a number of articles of the Criminal Procedure Code; Law amending and supplementing a number of articles of the Law on Vietnamese Nationality; Law on Cadres and Civil Servants (amended); Law amending and supplementing a number of articles of the Civil Procedure Code, the Administrative Procedure Law, the Juvenile Justice Law, the Bankruptcy Law and the Law on Mediation and Dialogue at Court; Law amending and supplementing a number of articles of the Law on Bidding, the Law on Investment under the Public-Private Partnership model, the Customs Law, the Law on Export Tax and Import Tax, the Investment Law, the Law on Public Investment, the Law on Management and Use of Public Assets; Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations; Law amending and supplementing a number of articles of the Law on Organization of the People's Procuracy; Law amending and supplementing a number of articles of the Law on Enterprises; Law amending and supplementing a number of articles of the Law on Product and Goods Quality; Law amending and supplementing a number of articles of the Law on Credit Institutions; Law amending and supplementing a number of articles of the Law on Election of National Assembly Deputies and People's Council Deputies; Law amending and supplementing a number of articles of the Law on Promulgation of Legal Normative Documents; Law on Inspection (amended); Law on Special Consumption Tax (amended); Penal Code (amended)...

These laws all come into effect from July 1, 2025.

Notably, the Law on Cadres and Civil Servants (amended) has completed regulations to implement the policy of building a unified, interconnected, and synchronous civil service from the central to the commune level, without distinguishing between commune-level and provincial-level cadres and civil servants; at the same time, supplementing and completing regulations to transform the method of managing cadres and civil servants according to job positions, taking job positions as the center, on the basis of the requirements of job positions and results and products of performing tasks to recruit, arrange, use, evaluate, train, plan, and appoint cadres.

Also effective from July 1, the Law amending and supplementing a number of articles of the Law on Organization of the People's Procuracy stipulates that the system of the People's Procuracy includes: the Supreme People's Procuracy; the People's Procuracy of provinces and cities; the People's Procuracy of regions; and the Military Procuracy at all levels. The number of Procurators of the Supreme People's Procuracy shall not exceed 27 people. The total payroll of the People's Procuracy and the Military Procuracy shall be decided by the Chief Procurator of the Supreme People's Procuracy at the proposal of the competent authority. The number of Procurators, the proportion of the Procurator ranks at each level of the People's Procuracy; the number and proportion of the Investigator ranks of the Supreme People's Procuracy shall be decided by the Standing Committee of the National Assembly upon the proposal of the Chief Procurator of the Supreme People's Procuracy after receiving the Government's opinion...
