Continuing the agenda of the 10th session, this morning (November 28), the National Assembly discussed in the hall the Draft Law on Planning (amended).
National Assembly deputies assessed that the draft Law on Planning (amended) has many innovative and creative provisions, which help to remove bottlenecks and promote the effectiveness of planning tools for the country's socio-economic development.
At the same time, delegates made many suggestions and comments to help perfect this draft Law with the hope that the Law will be truly synchronous, effective and meet development requirements, becoming a framework law as the foundation for specialized laws related to planning.
Explaining the contents of concern to National Assembly Deputies, Minister of Finance Nguyen Van Thang said that the scope of regulation of the Law aims to accurately reflect the nature and relationship between plans and has sufficient basis to handle conflicts between types of plans. Therefore, the Draft Law has adjusted the concept of "specialized technical planning" to the concept of "detailed sector planning" and added it to the scope of regulation of the Law.
The Planning Law is a framework law, only regulating the principled provisions on the relationship, handling of conflicts between plans and requirements of planning content. Specialized Laws will specifically regulate the establishment, appraisal, approval, adjustment and content of detailed sectoral planning, urban and rural planning.
Regarding the relationship and handling of conflicts between plans, Minister of Finance Nguyen Van Thang said that, taking into account the opinions of National Assembly deputies, the draft Law has stipulated principles to ensure a mechanism for handling conflicts between sectoral plans, between national and regional plans and provincial plans, and between sectoral detailed plans and other plans in the system. Planning adjustments in case of conflicts between plans are carried out according to a simplified procedure.
"In reality, the biggest difficulty is still the sectoral planning and the planning at the same level that are contradictory and overlap with each other. This is the issue we are trying to resolve as thoroughly and quickly as possible when there is overlap or conflict," Minister Nguyen Van Thang emphasized.
Regarding the list of sectoral planning and detailed sectoral planning, Minister of Finance Nguyen Van Thang said that, in terms of hierarchy, sectoral planning is national-level planning, ranked above provincial planning.
The contents of sectoral planning and sectoral detailed planning have been thoroughly consulted with relevant ministries and sectors many times. Up to now, the number of sectoral planning and sectoral detailed planning has been reviewed and minimized to overcome the overlapping content between the plans. At the same time, unnecessary and no longer suitable plans have been abolished.
Clarifying the detailed sectoral planning in the Draft Law, Minister Nguyen Van Thang emphasized that the 2017 Planning Law has provisions on the concept and list of planning of a specialized technical nature, but it is not within the scope of regulation. This leads to many different understandings of the role and position of this type of planning and especially there is no legal basis to handle conflicts between planning in the national system and planning of a specialized technical nature.
Therefore, in this Draft Law, the concept of "specialized technical planning" has been changed to "detailed sector planning" and the list has been revised to reduce the number of plans. Only detailed sector planning is established for a number of sectors on the development of total infrastructure using resources as a basis for project implementation.
"Adding detailed sectoral planning to the Draft Law will help remove difficulties and obstacles related to handling conflicts between plans, especially assessing the project's conformity with the plan in the step of approving investment policies or making investment decisions," Minister Nguyen Van Thang emphasized.
