For localities that are implementing or are about to implement many projects such as Dong Nai , this decentralization not only shortens the time for site clearance but also creates motivation to improve the capacity of grassroots officials, contributing to the effective operation of the 2-level local government model.
New tasks for commune level
In June 2025, the Government issued Decree 151/2025/ND-CP regulating the decentralization of authority of local governments at two levels, decentralization, and decentralization in the land sector. Accordingly, from July 1, 2025, tasks such as asset inventory, land origin determination, and preparation and approval of compensation, support, and resettlement plans will be carried out directly at the commune level, instead of being assigned entirely to the district or provincial level as before.
Chairman of Xuan Que Commune People's Committee Le Van Binh said: The locality is reclaiming 1,000 hectares of land to implement the Project of Investment, Construction and Business of Infrastructure of Xuan Que - Song Nhan Industrial Park (Phase 1). The commune has established a Compensation, Support and Resettlement Council chaired by the Vice Chairman of the Commune People's Committee; coordinated with the Provincial Land Fund Development Center to develop a compensation, support and resettlement plan; and together with the investor, publicly announced the 1/2,000 scale construction zoning plan and solicited public opinions.
Mr. Le Van Binh said: When the commune directly implements, it will be easier to grasp the progress and mobilize people.
In Phuoc Son commune, Party Secretary and Chairman of the People's Council Nguyen The Hai said: In the area, there is a project to invest in the construction of the North-South Expressway in the West, Gia Nghia - Chon Thanh section, passing through nearly 11km, including 1 intersection. Determining this as a national key project, the commune invited households to meetings, informed about the policy, and coordinated in land counting, placing road boundary stakes for site clearance. In general, people are in high agreement, but the locality is still waiting for the competent authority to issue compensation prices to implement the next steps.
Ms. Tong Thi Thom’s family (Phuoc Son commune) has 3 hectares of rubber, of which nearly 2 hectares were confiscated to implement the North-South Expressway Construction Investment Project, West section, Gia Nghia - Chon Thanh. Ms. Thom expressed: “Although we lost a lot of land, my family supports it because the expressway will shorten travel time and create development momentum. I just hope that the State will compensate appropriately so that people can stabilize their lives and develop the economy .”
Deputy Director in charge of the Provincial Construction Investment Project Management Board Dinh Tien Hai said: The unit was assigned to be the investor of land acquisition for 2/5 component projects of the North-South Expressway Construction Investment Project, West section Gia Nghia - Chon Thanh. Up to now, the unit has completed the measurement, placed land acquisition stakes and handed over the products to the branches of the Provincial Land Fund Development Center and localities to carry out compensation, support and resettlement according to regulations. Currently, the units have basically completed the land acquisition notice, measurement and inventory, are urgently determining the price and are expected to approve the compensation plan in November 2025.
To enable the establishment to exercise its vested rights
Dong Nai is implementing and will soon implement many projects with land acquisition such as: North-South Expressway West section Gia Nghia - Chon Thanh (more than 1 thousand hectares, over 2.1 thousand households affected), Hiep Hoa Urban Area (more than 290 hectares, over 1.7 thousand households affected), Dau Giay - Tan Phu Expressway (nearly 380 hectares, over 1.5 thousand households affected). For the commune level to perform its tasks well, it needs support from the provincial departments and branches in terms of human resources, expertise, and related regulations.
Chairman of Xuan Que Commune People's Committee Le Van Binh added: Currently, the commune only has one land official in charge of compensation, so it is still confused when making and appraising compensation plans. In addition, the province has not issued a unit price for surveying and mapping services, causing delays in making estimates and signing surveying contracts. The commune proposed that the Department of Agriculture and Environment support the confirmation of land origin, open professional training courses for grassroots staff; and the Department of Finance guide the establishment of a land valuation council.
Vice Chairman of Tran Bien Ward People's Committee Pham Duc Hoang said: In the area, there are many land acquisition projects that are in the process of approving compensation plans and considering resettlement. When the ward continues to carry out this task, it will take a long time to complete. In addition, the on-site resettlement arrangement has not met the requirements, which may affect the progress of site clearance for the projects.
Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee Vo Tan Duc said: Dong Nai is implementing and will soon implement many key infrastructure projects. To ensure the progress of public investment disbursement, and at the same time ensure that the project is implemented and completed on schedule, the land acquisition and resettlement stage is very important. The province is developing a decision on regulations on compensation, support, and resettlement applicable in Dong Nai province; issuing documents regulating decentralization and delegation of authority for commune level implementation. At the same time, directing functional branches to monitor and support commune level in handling issues of compensation, support, and resettlement consideration; organizing professional training for commune officials on procedures, records, and land acquisition and resettlement forms.
Land acquisition is a difficult task, initially being “empowered” may still have confusion and problems, however, the leaders of communes in Dong Nai believe that when fully equipped with knowledge, tools and coordination from the province, the commune level will carry out the task effectively. From there, it contributes to shortening the time for land acquisition for projects, especially national key projects, creating high consensus among people whose land is recovered.
