Private economic development: If post-inspection is not strong enough, "ghost companies" will take advantage

Reality has shown that many subjects have taken advantage of the open policy to set up hundreds of companies that do not actually operate, buy and sell invoices, evade taxes, launder money, cause budget losses and distort the competitive environment.

On the morning of May 16, the National Assembly discussed in the hall the draft Resolution of the National Assembly on mechanisms and policies for private economic development. National Assembly delegates all hope to have a resolution with depth and high feasibility.

There must be many special mechanisms to support the private economy.

Speaking at the discussion, delegate Tran Hoang Ngan (HCMC) stated that Resolution 68 is very important, especially at a time when the country is preparing to enter an era of accelerated development. The private economic sector accounts for 51% of GDP and contributes 33% of total budget revenue, deciding up to 55% of total social investment capital, which the Central Government has identified as the most important driving force of the economy. Therefore, we must have many special mechanisms to support the private economy to promote its important role and driving force.

Giving specific suggestions, Deputy Tran Hoang Ngan suggested clarifying the concept of innovative start-up enterprises. Regarding improving the business environment, the Deputy said that our current goal is to have 2 million private enterprises by 2030, and to achieve this goal, we must have very special solutions. Because currently, the average number of enterprises increases by only about 30,000 - 40,000 each year, so if there is no strong enough solution, after 5 years, it will be difficult for us to have 2 million enterprises.

“Therefore, there must be a policy to support individual business households to convert to enterprises, only then can this goal be achieved. At the same time, we must improve and expand larger-scale enterprises,” said Deputy Tran Hoang Ngan.

According to Deputy Tran Hoang Ngan, what businessmen are very interested in is clarifying the responsibility of legal entities with personal responsibility, as well as between criminal responsibility and administrative responsibility. Therefore, it is necessary to review all relevant laws such as the Criminal Procedure Code, the Civil Code, the Penal Code, reviewing these regulations is very important for businessmen.

Regarding support for land and production and business premises, Deputy Tran Hoang Ngan proposed adding the content that localities with land, potential and strengths must create a mechanism for localities to establish and expand industrial parks for private enterprises and small and medium enterprises to rent at a support price.

“We aim to become a developed country with high income, economic independence and self-reliance. To be economically independent and self-reliant, the private sector must be strong, and there must be mechanisms to support finance, credit, and land access. Therefore, there must be a provision to encourage localities to create clean land for the private sector,” said Deputy Tran Hoang Ngan.

Similarly, regarding the interest rate support policy, according to Deputy Tran Hoang Ngan, it must be very clear. Because in the past, we had policies but they were not implemented effectively, so this time we must clarify where the budget support mechanism is so that commercial banks can disburse loans to businesses.

It is necessary to clearly define the sectors and fields that are required to be pre-inspected.

Regarding the principles of state management of the private economic sector, Deputy Nguyen Thi Viet Nga (Hai Duong) completely agreed with the policy of strongly shifting from pre-inspection to post-inspection, especially in the management of business conditions. This is a direction in line with international practices, contributing to reducing compliance costs for businesses, encouraging start-ups, innovation and production expansion. However, the Deputy said that if there is no strong, transparent and effective post-inspection mechanism, this policy can easily become a loophole for "ghost companies" to exploit.

Reality has shown that many subjects have taken advantage of the open policy to set up hundreds of companies that do not actually operate, buy and sell invoices, evade taxes, launder money, cause budget losses and distort the competitive environment. In one case, the authorities discovered more than 600 "ghost" enterprises issuing over 1 million fake invoices, with a transaction value of up to nearly 64,000 billion VND.

Therefore, the Russian delegate believes that it is necessary to clearly supplement specific requirements for the post-audit system: data connection between tax, customs and banking agencies; field inspection; application of digital technology in supervision, especially with sanctions that are strong enough to deter. At the same time, it is necessary to clearly define the sectors and fields that are required to be pre-audited, based on risks and international experience, to avoid widespread or loose application.

Through discussion, the delegates all agreed that developing the private economy is a long-term strategic task, but also an urgent requirement at present. Therefore, a resolution with focus, depth, and high feasibility is needed to create real motivation for private enterprises to develop, thereby contributing more to the sustainable development of the country.
