“Mock trial” to propagate traffic laws at Bien Hoa Specialized High School

In order to innovate the most effective way of propagating and disseminating the law to students, contributing to building a safe and healthy school cultural environment, on the morning of September 25, at Bien Hoa High School for the Gifted, the People's Procuracy of Phu Ly City coordinated with the school's Board of Directors to organize a mock trial to propagate and disseminate legaleducation on traffic safety.

The given situation is: At about 1:45 p.m. on February 12, 2023, NVQ (born August 27, 2006, residing in Group 1, Tran Hung Dao Ward, Phu Ly City, Ha Nam Province), currently a student of class 11A1 at Binh Minh High School, woke up late and went to his yard to see his biological father, Mr. NVH (born in 1976), standing near a motorbike (125cm3). Q hurriedly said, "Dad, lend me your motorbike to go to school. I'm late for school." Mr. H said, "Okay" and gave the motorbike key to Q. While Q was driving the motorbike from home to school, he collided with a Honda Cub 50 motorbike (50cm3) driven by Ms. NTL (born in 1989, residing in Thanh Chau Ward, Phu Ly City). Consequences: 2 motorbikes fell onto the road, Ms. L died on the spot, D was thrown onto the road, injured and taken to the provincial General Hospital for emergency treatment. The Investigation Police Agency - Phu Ly City Police measured the alcohol concentration in Q's breath and tested for drugs through urine. The result of Q's alcohol concentration in breath was 0.35 milligrams/01 liter of breath and negative for drugs.

In the Forensic Autopsy Conclusion No. 1532/KL-KTHS of the Criminal Techniques Department of the Provincial Police, it was concluded: "The cause of death of Ms. NTL was severe traumatic brain injury and maxillofacial trauma."

Through analysis at the trial, the underlying cause of this behavior for the defendant NVH was that he knew that NVQ (his son) was a student, underage, and did not have a driver's license as prescribed, but agreed to hand over the 125m3 motorbike to Q to drive. Meanwhile, Q was still driving under the influence of alcohol, could not control the speed, and crashed into Ms. N and TL, leading to their death.

In addition, the indictment of the representative of the People's Procuracy, the arguments of the trial panel, lawyers, and legal assistants further clarified the nature of the case, helping students better understand the violations.

Based on the proposal of the representative of the Procuracy, the Trial Panel sentenced the defendant NV Q to 12 months in prison for the crime of "Violating regulations on driving vehicles on roads" as prescribed in Clause 2, Article 260 of the Penal Code; NVH to 24 months of non-custodial reform for "Crime of allowing an unqualified person to drive a road vehicle" as prescribed in Point a, Clause 1, Article 264 of the Penal Code.
