National Assembly discusses social housing development policy

Today, the first working day of the second phase of the 5th session, the National Assembly will give opinions on policies for developing social housing, workers' housing, as well as the management mechanism of apartment buildings.

According to the Government 's proposal, the new point in the draft Law (Housing) is to remove the regulation that investors building commercial housing must reserve 20% of land area to develop social housing.

The Ministry of Construction - the drafting agency - explained that the current regulation requires investors of commercial housing and urban areas to reserve 20% of their land fund, but in reality, many shortcomings have been revealed. Because the demand for social housing in localities is different, some places need to develop high-end commercial and resort projects, so such "rigid" regulations can affect landscape architecture and waste land resources.

On the other hand, social housing development is the responsibility of the State. Investors of commercial housing projects and urban areas in business investment have fulfilled financial obligations to the State such as land use fees, taxes, and fees. Therefore, this agency considers it appropriate not to stipulate additional responsibilities of investors of commercial housing projects and urban areas to contribute funds to build social housing.

The Ministry of Construction said that the Vietnam General Confederation of Labor's development of social housing for workers is consistent with the functions and tasks of this agency (stated in the 2013 Constitution and the 2012 Trade Union Law). Accordingly, the General Confederation is "a representative of workers, caring for and protecting the legitimate and legal rights and interests of workers".

According to the Ministry of Construction, to date, the country has completed 307 urban social housing projects with 157,000 units; 418 projects with 432,000 units are being implemented. The Government aims to have at least one million social housing units by 2030, of which 428,000 units will be completed by 2025; the total expected capital is VND849,000 billion, mainly from socialized capital.

Regarding the management and use of apartment buildings , there are opinions suggesting reviewing the reasonableness of the regulation on paying 2% of maintenance fees immediately after handover, because newly built houses do not need maintenance yet, and keeping this amount of money leads to negative consequences.

According to the Ministry of Construction, the regulation that buyers must pay a 2% maintenance fee when receiving the apartment is not new and has been in place since 2005. "This regulation is still consistent with the actual situation to ensure that funds are available to carry out maintenance when there is damage to common property," the Ministry of Construction assessed.

Because, if there is a need for maintenance work, it will be difficult to pay the maintenance fee because the user does not pay, leading to no funds to maintain the apartment building. This is also the current situation in old apartment buildings.

To strictly manage and overcome the situation of arbitrary spending of apartment maintenance funds, the draft law stipulates the mechanism for establishing accounts and the responsibilities of investors and the Management Board in managing and using this maintenance fund.

According to the working program, on June 19, the National Assembly also voted to approve the Resolution approving the 2021 budget settlement; and to pass the Law on Prices (amended). National Assembly deputies will also discuss in groups the draft Law on Real Estate Business (amended) after listening to Minister of Construction Nguyen Thanh Nghi, authorized by the Prime Minister, read the report.
