The National Assembly set the unemployment benefit level at 60% of the average salary.

The Law on Employment (amended) recently passed by the National Assembly maintains the monthly unemployment benefit level at 60% of the average monthly salary for unemployment insurance contributions of the 6 most recent months of contributions before the termination of the labor contract, work contract or termination of employment.

On the morning of June 16, with 455/459 delegates present voting in favor, the National Assembly passed the Law on Employment (amended).

The Law on Employment (amended) stipulates that the monthly unemployment benefit is equal to 60% of the average monthly salary for unemployment insurance contributions of the 6 most recent months of unemployment insurance contributions before the termination of the labor contract, work contract or termination of employment.

At the same time, this benefit level is not more than 5 times the regional minimum monthly wage announced by the Government applied in the last month of unemployment insurance payment.

The period of unemployment benefits is calculated based on the number of months of unemployment insurance contributions. If you have paid for 12 to 36 months, you will receive 3 months of unemployment benefits. After that, if you have paid for another 12 months, you will receive 1 more month of unemployment benefits, but the maximum period of unemployment benefits is 12 months.

The time to receive unemployment benefits is the 11th working day from the date of submitting complete unemployment benefits application.

Employees receiving unemployment benefits are entitled to health insurance benefits in accordance with the provisions of the law on health insurance, including the period of suspension of unemployment benefits as prescribed in Clause 2, Article 41 of this Law. Employees receiving unemployment benefits are entitled to health insurance contributions from the Unemployment Insurance Fund by the social insurance agency.

Reporting on the reception, explanation and revision of the draft Law before the National Assembly votes to approve it, Chairman of the Committee for Culture and Social Affairs Nguyen Dac Vinh said that regarding the monthly unemployment benefit level, there is a proposal to increase the monthly unemployment benefit level to a minimum of 65% and allow the Government to adjust it up to a maximum of 75% in the event of a large-scale economic crisis or epidemic.

In addition, there is also a proposal to increase the benefit level to 70% but not more than 5 times the regional minimum wage and for every 6 months of unemployment insurance payment, an additional month of unemployment benefits will be received but not more than 12 months.

The National Assembly Standing Committee has directed a review and found that the surplus of the Unemployment Insurance Fund in the past period was mainly accumulated from the previous period, due to annual support from the State Budget, when the number of beneficiaries was still small. However, from 2020 to now, the annual revenue and expenditure of unemployment insurance are balanced.

According to the experience of countries that have successfully implemented unemployment insurance or employment insurance policies (Canada, Korea, Japan, Thailand...) and international standards on unemployment insurance, the unemployment benefit level is not less than 45% of previous income or not less than 45% of the prescribed minimum wage or the salary of a normal worker but not less than the minimum basic living standard; the minimum unemployment benefit period is 12 weeks (3 months) within a 12-month period.

In addition, the Labor Code (Articles 47 and 48) stipulates the responsibility of employers in paying severance allowance to employees who have worked regularly for 12 months or more (each year of work is paid 1⁄2 month's salary (50% of salary); unemployment allowance to employees who have worked regularly for them for 12 months or more (each year of work is paid 1 month's salary (100% of salary) but must be at least 2 months' salary (minimum 200% of salary).

According to the auditing agency, the benefit level is 60% of the average monthly salary for unemployment insurance contributions for 3 months, which is relatively consistent with international practice and the benefits that employees receive when they lose their jobs according to current regulations.

“This level ensures that workers will have less difficulty and a stable life during unemployment until they find a new job; in accordance with the contribution-benefit principle and the ability to balance revenue and expenditure of the Unemployment Insurance Fund,” said Director Nguyen Dac Vinh.

The Law on Employment (amended) takes effect from January 1, 2026. The Law on Employment No. 38/2013/QH13, which has been amended and supplemented by a number of articles under Law No. 41/2024/QH15, ceases to be effective from the date this Law takes effect.
