Kinhtedothi - On the morning of November 29, continuing the program of the 8th Session, the National Assembly passed the Law on Fire Prevention, Fire Fighting and Rescue.
Previously, on November 1, 2024, the National Assembly discussed in the Hall the draft Law on Fire Prevention, Fire Fighting and Rescue. Based on the opinions of the National Assembly deputies, the National Assembly Standing Committee directed the study, reception, and revision of the draft Law and the preparation of a Report on explanation, reception, and revision.
Do not arrange sleeping areas in production and business areas to prevent fire.
According to the provisions of the Law on Fire Prevention, Fire Fighting and Rescue passed by the National Assembly, the subjects of fire prevention and firefighting inspection include facilities under fire prevention and firefighting management; houses, houses combined with production and business; means of transport (road motor vehicles, railway vehicles, inland waterway vehicles, ships manufactured, assembled, newly built, converted to transport passengers, goods with fire and explosion hazards; in the case of road motor vehicles transporting passengers, they must have more than 8 seats - excluding the driver's seat); construction works during construction.
The authority to inspect fire prevention and fighting is stipulated as follows: Heads of establishments, household owners, vehicle owners, and investors shall organize fire prevention and fighting inspections themselves; Commune-level People's Committees, police agencies, specialized construction agencies, and inspection agencies, within the scope of their duties and powers, shall conduct fire prevention and fighting inspections in accordance with the provisions of law.
When establishing, adjusting, and approving general planning, zoning planning, detailed planning of urban areas, residential areas, industrial clusters, and functional areas according to the provisions of law on urban and rural planning, there must be solutions and designs on fire prevention and fighting suitable for each planning level.
When establishing or adjusting construction investment projects, designing works, renovating or changing the function of works and constructing temporary works according to the provisions of the law on construction, there must be solutions and designs on fire prevention and fighting suitable to the function and characteristics of the works.
Regarding fire prevention regulations for houses, houses in centrally run cities located in areas that do not ensure traffic infrastructure or water sources for fire fighting according to the provisions of law and technical standards in fire prevention and fighting activities must be equipped with fire extinguishers, fire alarm transmission equipment connected to the database system on fire prevention, fire fighting, rescue, and fire alarm transmission according to the roadmap prescribed by the Government . The People's Committee of centrally run cities determines areas that do not ensure traffic infrastructure or water sources for fire fighting.
Regarding fire prevention for houses combined with production and business, in addition to fire safety conditions according to regulations, areas for production and business of goods at risk of fire and explosion must have solutions to separate or prevent fire from residential areas.
Housing combined with production and trading of flammable and explosive goods must ensure fire safety conditions, not arrange sleeping areas in the production and trading areas; have fire alarms, ventilation solutions, and equipment to detect leaks of flammable and explosive gases suitable to the function and characteristics of the housing combined with production and trading of flammable and explosive goods; the production and trading area of flammable and explosive goods must be fire-proofed from the escape route of the residential area.
There is a solution to prevent fire in the charging place for electric motor vehicles in the house.
The Law on Fire Prevention, Fire Fighting and Rescue stipulates fire prevention in the installation and use of electricity for daily life and production, which stipulates that only electric vehicle charging equipment that meets national technical standards may be used; indoor electric vehicle charging areas must have solutions to ensure fire safety; indoor electric vehicle charging areas must also have fire prevention solutions and be equipped with appropriate fire-fighting equipment that meets standards.
In fire fighting, the fire fighting commander of the People's Public Security force has the rights to use the forces and means of the public security agency under its management to participate in fire fighting; mobilize according to authority or request competent persons to mobilize forces, people, means, and assets of agencies, organizations, households, and individuals to participate in fire fighting according to the provisions of law; determine and decide on the fire fighting area, fire fighting measures, use of surrounding terrain and objects for fire fighting; prohibit people and means without duties from entering the fire fighting area; decide on the movement and demolition of obstacles and assets for rescue, salvage, and prevention of the risk of fire spreading according to the provisions of law.
Agencies, organizations and individuals must participate in compulsory fire and explosion insurance for assets of establishments on the list of establishments required to purchase compulsory fire and explosion insurance and comply with the provisions of the law on insurance. Agencies, organizations and individuals are encouraged to participate in compulsory fire and explosion insurance for assets of establishments not on the list of establishments required to purchase compulsory fire and explosion insurance.
In addition, the Government shall prescribe the list of establishments required to purchase compulsory fire and explosion insurance; the contribution level, management regime, and use of revenue from compulsory fire and explosion insurance for fire prevention, firefighting, rescue, and relief activities.
