This Decision stipulates standards and norms for the use of machinery and equipment at agencies, organizations and units, including: Machinery and equipment serving the work of positions; machinery and equipment serving general activities; specialized machinery and equipment.
Subjects of application include: State agencies, agencies of the Communist Party of Vietnam , the Vietnam Fatherland Front Committee (including socio-political organizations), public service units, project management boards using state capital (hereinafter referred to as agencies, organizations, units); organizations and individuals involved in determining, deciding, and applying standards and norms for the use of machinery and equipment.
For non-budgetary state financial organizations that apply the financial mechanism and asset management mechanism of public service units, the standards and norms for the use of machinery and equipment shall comply with the provisions of this Decision.
The standards and norms for the use of machinery and equipment specified in this Decision are used as one of the bases for planning and budget estimates; and for the assignment, purchase, lease, management, use, and disposal of machinery and equipment.
Standards and norms for the use of machinery and equipment serving the work of each position are determined for each position and title. In the case of a person holding multiple positions and titles, the highest standard shall be applied. When the predecessor retires, transfers to another job or for other reasons no longer holds that position but the machinery and equipment already installed do not meet the conditions for replacement or liquidation according to regulations, the successor shall continue to use them and shall not equip new ones, except in cases where the machinery and equipment are decided to be disposed of by a competent authority or person according to the provisions of law on the management and use of public assets.
Alternate Central Party Committee members holding any position shall be subject to the standards and norms for the use of machinery and equipment according to their current position.
Specifically, machinery and equipment serving the work of the following positions: Head of Department, Deputy Head of Department, Board, agency and equivalent at commune level; specialists and equivalent positions at local level (including commune-level civil servants); individuals signing labor contracts according to Government regulations on contracts for certain types of work in administrative agencies and public service units, as follows: 1 set of desks and chairs, maximum price 7 million VND/set; 1 document cabinet with maximum price 7 million VND/unit; 1 desktop computer or laptop with maximum price 20 million VND/unit....
In case it is necessary to adjust the price of machinery and equipment as prescribed above, the price adjustment is regulated as follows: The head of the agency, organization or unit decides in case the price adjustment is not more than 15% higher than the prescribed price.
The Chief of the Central Party Office, Ministers, Heads of central agencies, the Standing Committee of the Central Committee of the Vietnam Fatherland Front , the Standing Committee of provincial and municipal Party Committees, and the People's Committees at provincial level shall decide or delegate the authority to decide in cases where the price adjustment is higher by more than 15% to no more than 30% compared to the prescribed price.
According to the Decision, machinery and equipment serving general activities include: Machinery and equipment serving general activities equipped in the office; Standards and norms are as follows: Meeting and reception table and chair set, maximum 1 set/office, maximum price 13 million VND/set; printer maximum 1 unit/3 positions, maximum price 13 million VND/unit; document scanner 1 unit/15 positions, maximum price 22 million VND/unit...
Machinery and equipment serving the general operations of agencies, organizations, units and machinery and equipment attached to houses, architectural structures, construction works, including: elevators; fire prevention and fighting systems; lighting systems; information systems; air conditioners; cameras; sound; sanitary equipment; tables and chairs for auditoriums, meeting rooms, generators; water pumps; televisions; LED screens; projectors; other machinery and equipment.
The provision of machinery and equipment specified in Point b above shall be decided by the competent authority or person specified in Clause 3, Article 4 hereof based on the functions, tasks, usage needs, design and construction of working headquarters, public service facilities and permitted funding sources of the agency, organization or unit. The replacement of machinery and equipment specified in Point b, Clause 1 of this Article shall be determined according to the type and quantity of machinery and equipment to be replaced; the price of replacement machinery and equipment shall be determined in accordance with the market purchase price of the corresponding type of machinery and equipment.
Specialized machinery and equipment, including: Specialized machinery and equipment in the fields of healthcare, education and training; b) Specialized machinery and equipment other than the specialized machinery and equipment specified in point a.
Standards and norms for the use of specialized machinery and equipment specified in Point a above: Within 12 months from the effective date of this Decision, the Minister of Health and the Minister of Education and Training shall provide detailed guidance on standards and norms for the use of specialized machinery and equipment in the fields of health, education and training under the state management of the Ministry of Health and the Ministry of Education and Training.
Standards and norms for the use of specialized machinery and equipment specified in Point b: Specialized machinery and equipment specified in this Clause are machinery and equipment specified in Appendix I and Appendix II issued with this Decision but with requirements on features, capacity, configuration and higher prices according to regulations of specialized laws or determined by the Head of the agency, organization or unit on the basis of suitability with the functions, tasks and nature of the work; machinery and equipment serving state secret work; machinery and equipment equipped for reception rooms and one-stop shops; other machinery and equipment serving specific tasks of agencies, organizations and units.
