Check, control closely
In order to seriously and effectively implement the direction of the Government and the Prime Minister , the City People's Committee issued a plan to launch a peak period to combat smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights in the area, and at the same time issued Decision No. 1623/QD-UBND to establish a peak working group to combat, prevent, and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights. From here, departments, branches, and localities, according to their assigned functions and tasks, will closely follow the direction and synchronously implement it.
On May 20, the inspection team of the Da Nang Market Management Department suddenly inspected a business location in Hai Chau district, discovering 127 products such as handbags and wallets with signs of counterfeit trademarks; the total value of the violation was more than 151 million VND. The team drew up a record, temporarily detained all the violating goods, completed the case file and submitted it to the Da Nang Market Management Department to request the Chairman of the City People's Committee to issue a decision to impose an administrative penalty with a proposed fine of more than 111 million VND.
Similarly, at 10:00 a.m. on June 6, the Economic Police Department (City Police) coordinated with other units to conduct a surprise inspection of the headquarters of Hanh Nguyen Beauty Trading and Service Company Limited (134-136 Nguyen Hoang, Thac Gian Ward, Thanh Khe District) directed by NTMH, 37 years old, residing in My An Ward, Ngu Hanh Son District. Through the inspection, more than 1,000 cosmetic products without invoices or documents proving their legality were temporarily seized, along with a number of tools used to decant cosmetics and nearly 3,000 boxes, packages, and labels used for packaging and manufacturing Lovelny Beau cosmetics. By June 20, the Economic Police Department had initiated a case, prosecuted the accused, and issued an order prohibiting NTMH from leaving her place of residence for the crime of manufacturing and trading in counterfeit cosmetics. The case is currently under further investigation.
According to statistics, from May 15 to June 15, the city's functional forces organized inspections of 217 cases. The total number of cases handled was 135 (140 acts); including smuggled goods, prohibited goods (11 cases), infringement of intellectual property rights (36 cases), commercial fraud (93 cases) with a total amount of fines, tax arrears and confiscated goods sales of more than 3.7 billion VND (the amount of fines collected was more than 3 billion VND, the amount of tax arrears was more than 513 million VND, the amount of confiscated goods sales was more than 167 million VND). The total number of cases being handled is 16 cases. In addition, the functional forces confiscated and destroyed more than 1,000 packs of smuggled foreign cigarettes of all kinds, 57 electronic cigarette machines, and forced the destruction of more than 700 units of counterfeit branded goods worth more than 600 million VND; At the same time, nearly 5,000 units of goods are being temporarily detained, including smuggled goods, goods of unknown origin, and goods with signs of counterfeit trademarks.
Towards a transparent business environment
According to the Department of Industry and Trade, after simultaneously implementing a peak period of fighting against smuggling, trade fraud, counterfeit goods, and intellectual property infringement in the city, the trading of infringing goods by businesses on central tourist streets has shown a clear downward trend. Some stores have stopped operating, while others mainly display and trade goods with clear origins... This helps create a safe and transparent business environment, protecting the legitimate rights of honest businesses and consumers. On the other hand, in parallel with the inspection and handling of violations, the combination of propaganda and dissemination of laws in commercial business activities to business organizations and individuals has contributed to raising awareness of businesses, contributing to limiting the trading of infringing goods. People and consumers grasp information promptly, thereby avoiding buying counterfeit goods, poor quality goods, goods of unknown origin; restrict the consumption of illegal goods by businesses in the city.
Mr. Pham Ngoc Son, Deputy Director of the Department of Industry and Trade, said that the department continues to direct the Da Nang Market Management Department to closely follow and strictly implement the directions of the Prime Minister, the Government, the National Steering Committee 389, the Ministry of Industry and Trade and the City People's Committee in the fight to prevent and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights in Da Nang. In particular, focusing on strengthening professional measures; synthesizing, evaluating, classifying subjects and goods, identifying behaviors, methods, and tricks to have appropriate plans to fight at each time. At the same time, the market management force proactively coordinates with functional forces to promptly inspect and strictly handle organizations and individuals with violations; deploy professional market management measures; promptly detect, develop plans, organize surprise inspections and strictly handle violations in the production and trading of goods and services, especially in the trading of milk, western medicine, pharmaceuticals, cosmetics, health protection foods, medicinal herbs, traditional medicine ingredients, etc. The subordinate market management teams proactively deploy professional measures to detect, prevent and handle according to the law for organizations and individuals who violate on e-commerce websites and applications; set up e-commerce websites without notifying competent state management agencies or take advantage of e-commerce to trade in prohibited goods, smuggled goods, counterfeit goods, goods of unknown origin.
