Facilitate business recovery and operation

On the morning of October 23, the National Assembly Delegation of Son La province and the National Assembly Delegation of Vinh Long province discussed at Group 13 the following projects: Bankruptcy Law (amended), Deposit Insurance Law (amended), Press Law (amended), Population Law, and Disease Prevention Law.

Towards recovery

Discussing the Bankruptcy Law (amended), delegate Thach Phuoc Binh ( Vinh Long ) proposed to change the name to "Law on Rehabilitation and Bankruptcy" to more fully reflect the law's objectives, not only focusing on bankruptcy handling but also emphasizing the business recovery process.

The delegate also emphasized the need to clearly define recovery support tools in the State's policies, including: debt relief, tax deferral, recapitalization and credit guarantees for enterprises eligible for restructuring; Prioritizing access to low-interest loans and suspending asset repossession for a period of 12-24 months to give enterprises the opportunity to restore production.

In addition, an inter-sectoral coordination mechanism should be established between the Court, the Ministry of Finance , the State Bank and the Social Insurance Agency to quickly handle recovery cases. Delegates also recommended piloting the establishment of a specialized bankruptcy court to improve the efficiency of handling related cases.

Sharing the same view, delegate Nguyen Truc Son (Vinh Long) said that the application of administrative procedures to enterprises currently still faces many difficulties. Therefore, amending the Bankruptcy Law is very necessary. He proposed that the draft law should clearly stipulate the recovery procedure to ensure comprehensiveness.

Regarding the issue of recovery and bankruptcy costs, according to delegate Nguyen Truc Son, there needs to be a clear basis to determine the time for reimbursement from the state budget. If this time lasts from 3 to 5 years, the expenditure will no longer be in the budget, causing difficulties for financial management.

Regarding the simplified procedure, delegate Son emphasized the need to clearly distinguish between small, medium and large-sized enterprises. For large enterprises, the simplified procedure can have a great impact on related parties, so specific regulations are needed to ensure the rights of all affected parties. The delegate also emphasized the importance of transparency in the responsibilities of enterprises towards related parties, especially during the restructuring or bankruptcy process. This is to ensure the legitimate rights of the parties and increase confidence in the legal system.

From "cure" to "prevention"

According to delegate Nguyen Thi Quyen Thanh (Vinh Long), the development and promulgation of the Law on Disease Prevention is an important step to change the mindset from "treating diseases" to "preventing diseases", improving the health of the whole population. This is not only the task of the health sector but also the responsibility of the whole society.

The law should affirm the importance of universal health care across the life cycle, considering investment in disease prevention as investment in sustainable development. To be effective, it is necessary to specify policies such as free periodic health check-ups, electronic health management, and socialization of disease prevention work.

Regarding the Population Law, delegates emphasized that maintaining the replacement level of fertility is the top priority in the context of Vietnam's rapidly declining fertility rate. Long-term support policies such as reducing child-rearing costs, supporting social housing, preschool education, and health care need to be focused on. At the same time, it is necessary to expand support policies for children in disadvantaged areas and research measures to support infertility treatment.

Delegates also recommended the need to develop appropriate social security, health and rehabilitation policies, and encourage the development of community-based elderly care models. Investing in the elderly is not only a responsibility but also an opportunity to take advantage of their experience and contributions to society.

To improve the legal policies on population, delegates also recommended integrating population work into the development plans of the sector and localities; adding acts prohibiting fraud, violating privacy related to reproduction, and reproductive sex brokerage; and emphasizing the role of premarital health counseling to ensure healthy childbearing plans.

Regarding elderly care, some opinions suggest expanding the geriatric network from central to grassroots levels, combining digital technology with healthcare and social security. In addition, it is necessary to focus on training specialized human resources, developing geriatric nursing, and expanding international cooperation. The policy of allowances for hazardous jobs also needs to be considered to create motivation for development.
