Focus on amending regulations related to the organization of the People's Procuracy.

The draft Law on amending and supplementing a number of articles of the Law on Organization of the People's Procuracy presented by Chief Justice of the Supreme People's Procuracy Nguyen Huy Tien said that the development of this Law aims to perfect the legal basis for the organization of the People's Procuracy to ensure conformity with the arrangement and streamlining of the apparatus into 3 levels: the Supreme People's Procuracy, the Provincial People's Procuracy, and the Regional People's Procuracy according to the Party's policy.

Based on the policies of the Party and the State, with the scope and viewpoints on the construction of the above-mentioned Law project, the Supreme People's Procuracy proposes a draft Law consisting of 3 Articles. In which, amending and supplementing a number of articles of the Law on Organization of the People's Procuracy with the following contents: Amending and supplementing Clause 2, Article 7; Points a and c, Clause 2, Article 22; Clause 3, Article 23, Clause 1, Article 24; Article 40; Article 41; Clause 3, Article 47; Article 48; Article 49; Clause 2, Article 66; Article 67; Article 68...

The draft Law also stipulates transitional provisions in the direction that from July 1, 2025, the transfer of tasks and powers to exercise the right to prosecute and supervise judicial activities between the People's Procuracies at all levels shall be implemented in accordance with the provisions of the laws on litigation and other relevant legal provisions. The transfer, receipt, management and use of finances and assets of the District People's Procuracy and the High People's Procuracy shall be implemented in accordance with the provisions of the law on the state budget and public assets.

The report on the review of the draft Law presented by Chairman of the Committee on Law and Justice Hoang Thanh Tung stated that the Committee agreed with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on Organization of the People's Procuracy.

Regarding the additional number of Supreme People's Procuracy Prosecutors (Clause 11, Article 1), the draft Law stipulates no more than 27 people, while the current Law on Organization of the People's Procuracy stipulates no more than 19 people).

The Committee recommends that the proposal to increase the number of prosecutors from 19 to 27 at the Supreme People's Procuracy to meet the increase in cases at the central level due to the end of the operation of the people's court and the high-level people's procuracy be carefully considered, which is not consistent with the Party's consistent policy of streamlining the apparatus, promoting decentralization and delegation of power, and avoiding the accumulation of cases at higher levels, especially the accumulation of cases at the central level.

Because this is an important issue related to the Party's policy, the Supreme People's Procuracy's Procuratorate is under the management of the Secretariat. Therefore, when amending the Law on Organization of the People's Procuracy in 2014, it was also necessary to report and seek opinions from competent authorities on the number of Supreme People's Procuracy's Procurators. Although the Project of the Supreme People's Procuracy submitted to the Central Executive Committee proposed the above content, Resolution No. 60-NQ/TW of the Central Committee has not specifically concluded this issue. Therefore, it is recommended that the Supreme People's Procuracy carry out the procedure of seeking opinions from competent authorities in accordance with the Politburo's Regulations.

The majority of opinions of the National Assembly Standing Committee agreed to amend and supplement a number of articles of the Law on Organization of the People's Procuracy to institutionalize the Party's policies on innovation and streamlining the political system's apparatus to operate effectively and efficiently, including the People's Procuracy's apparatus.

Permanent Deputy Chairwoman of the People's Aspirations and Supervision Committee Le Thi Nga said that in the context of simultaneously implementing amendments to many laws in the judicial field, it is necessary to continue reviewing the relevant legal system to ensure consistency.

Expressing agreement with the addition of the number of Supreme People's Procuracy Prosecutors due to the large amount of work transferred from lower-level Procuracies to the Supreme People's Procuracy, the Standing Deputy Chairman of the People's Aspirations and Supervision Committee suggested that it is necessary to seek the opinion of competent authorities to decide on this issue.

Considering that this is a draft law that has a great impact on the people, Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi suggested that when implementing it, it is necessary to strengthen extensive propaganda work to all classes of people to ensure the legitimate rights and interests of the people.

Concluding the working session, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the National Assembly Standing Committee agreed with the scope of the draft Law amendments, which only focused on amending the relevant regulations to arrange and streamline the organization of the People's Procuracy, in which the People's Procuracy has 3 levels, including: the Supreme People's Procuracy, the Provincial People's Procuracy and the Regional People's Procuracy.

At the upcoming Ninth Session, the National Assembly is expected to consider amending and approving laws on the organization of judicial agencies and codes on procedural law. Noting this, the Vice Chairman of the National Assembly suggested that agencies coordinate closely to ensure the consistency of these laws as well as the unity of the legal system.

The Vice Chairman of the National Assembly also requested that the drafting agency and the reviewing agency continue to closely coordinate and complete the draft Law dossier to submit to the National Assembly.
