Removing obstacles and difficulties, speeding up site clearance progress

In order to remove obstacles and difficulties, and speed up the progress of site clearance for projects, many departments, branches, units, and localities are actively completing the contents to submit to the city for promulgation of legal documents to soon concretize new policies, decrees, and regulations of the 2024 Land Law into the practice of compensation, support, and resettlement.

Accordingly, Hoa Vang district is focusing on reviewing documents, examining legality, inspecting, pricing, paying compensation and supporting clearance, arranging resettlement... to speed up the progress of site clearance for projects in the district, especially key driving force projects such as: the eastern expressway section Hoa Lien - Tuy Loan; upgrading and renovating National Highway 14B; Quang Da bridge and the bridge approach road; the western beltway; Hoa Phong commune administrative center; Hoa Bac commune center resettlement area (phase 2)...

The district's site clearance work is facing many difficulties and obstacles, mainly due to the lack of resettlement land; the unit price for compensation for damage to houses, structures and relocation of graves is still low; cases of building houses on land that is not residential land are not allocated resettlement land...

Director of the Hoa Vang District Land Clearance Board Nguyen Thanh Hung said that due to the transitional period between the policies of the 2013 Land Law and the 2024 Land Law, there are difficult issues in compensation, support and resettlement. The district has commented on a number of contents of the city's regulations on implementing the new policies of the 2024 Land Law and the contents replacing Decision No. 05/2021/QD-UBND and Decision No. 25/2023/QD-UBND of the City People's Committee on compensation, support and resettlement when the State reclaims land in the city.

The 2024 Land Law has some new provisions on compensation, support, and resettlement when the State acquires land, which are more beneficial to households that are cleared than the provisions of the 2013 Land Law. For example, land compensation prices are calculated based on specific land prices through land valuation methods (approaching or close to market prices), so land compensation prices may increase compared to present.

Meanwhile, the price of resettlement land is determined according to the land price list at the time of approval of the compensation, support and resettlement plan, so it will be more beneficial for the households to be cleared. In addition, people who are arranged for resettlement will be recorded as having financial obligations for resettlement land if they meet the conditions prescribed by the Government .

The 2024 Land Law also has a number of other new points to remove difficulties and obstacles, helping to speed up the progress of site clearance, such as adding more support for people whose land is recovered; households with multiple generations living together on a recovered plot of land are given additional resettlement land, leased, or leased to purchase housing for households that are still lacking; households and individuals whose agricultural land is recovered are compensated with land for the same or different purposes as the recovered land, or with money, suitable housing, etc.

Deputy Director of the Da Nang City Land Fund Development Center (Department of Natural Resources and Environment) Tran Ba Thanh said that, along with the new regulations of the 2024 Land Law, through reviewing the contents of this law and Decree No. 88/2024/ND-CP of the Government on compensation, support, and resettlement when the State recovers land, there are 18 contents assigned to the city to regulate in detail, further removing difficulties and obstacles in site clearance work.

Accordingly, the city will regulate the conversion rate, compensation conditions in land with a different purpose than the recovered land or in houses; minimum resettlement quota; time and support level during the waiting period for resettlement arrangement (temporary residence); reward mechanism for people whose land is recovered and hand over the site before the deadline; unit price for compensation for actual damage to houses, housing, construction works; unit price for compensation for damage to crops and livestock; compensation level for damage to aquatic products or other livestock that cannot be moved; compensation level and support due to the relocation of graves; resettlement support level, regulations on the arrangement of resettlement land plots with 2 frontage locations...

According to the Department of Natural Resources and Environment, in recent times, the Standing Committee of the City Party Committee and the City People's Committee have directly, regularly and resolutely directed the work of site clearance, especially directing and removing a series of obstacles in administrative mechanisms and procedures, including promoting decentralization and delegation of authority to the People's Committees and Chairmen of the People's Committees of districts and towns to carry out related work.

To continue to effectively remove difficulties and obstacles and speed up the progress of site clearance for projects in the city, the Department of Natural Resources and Environment is coordinating with departments, branches, sectors and localities to complete the content to submit to the City People's Committee to issue legal documents detailed in the 2024 Land Law and issue detailed regulations on compensation and support when the State reclaims land.

The Department also recommends that the city leaders continue to direct and enhance the leadership and direction of the Party Committee; the supervision of socio-political organizations as well as the work of mobilizing and propagating people to comply with and agree to implement policies on compensation, support and resettlement; strictly handle violations in the process of land use. Along with that, continue to strengthen the coordination between the city's departments, branches and sectors with localities to remove difficulties and obstacles, speed up the progress of site clearance for projects.
