These contents are in Articles 15 and 16 of the Draft Circular guiding the implementation of compulsory social insurance for military personnel and those working in cryptography who receive salaries similar to those of military personnel, which is being consulted by the Ministry of National Defense for completion. This Circular is expected to apply to: Officers and professional soldiers of the People's Army ; those working in cryptography who receive salaries similar to those of military personnel; non-commissioned officers and soldiers of the People's Army; military and cryptography students who are studying and are entitled to living expenses.
In case the above subjects, during the time of studying, practicing, working, researching, or receiving medical treatment abroad, still receive salary or military rank allowance or living expenses in the country, they are entitled to pay and enjoy the social insurance regimes prescribed in this Circular.
Time to receive pension
1. The time to receive pension is the time stated in the decision to retire and receive social insurance benefits of the competent authority.
2. The time to meet the age requirement for pension is the 1st day of the month following the month in which the employee meets the age requirement for pension.
In case the date and month of birth cannot be determined or records are lost and other special cases shall be implemented according to the provisions of the Government 's Decree.
3. The time to be eligible for retirement benefits due to reduced working capacity is the 1st day of the following month when the employee meets all three conditions of age, social insurance payment period and has a conclusion of reduced working capacity of 61% or more by the competent Medical Assessment Council.
4. In case the employee or employer submits the application later than prescribed, he/she must have a written explanation stating the reason and be responsible before the law for the explanation.

Lump sum pension upon retirement
One-time pension allowance prescribed in Article 68 of the Law on Social Insurance; Decree of the Government for employees prescribed in Clause 1, Article 2 of this Circular who are eligible for pension according to the provisions of the Decree of the Government and continue to pay social insurance, will receive a subsidy equal to 2 times the average salary used as the basis for paying social insurance for each year of payment higher than 35 years for men, 30 years for women up to the time of retirement according to the provisions of law.
Example 1: Colonel Hoang Van Bay, enlisted in February 1989, retired in April 2026, has 37 years and 2 months of social insurance contributions. Comrade Bay has a social insurance contribution period that is 2 years and 2 months longer than the number of years (35 years, corresponding to a pension rate of 75%) (calculated as 2.5 years), so in addition to the monthly pension, Comrade Bay is also entitled to a one-time pension upon retirement equal to 5 times the average salary used as the basis for social insurance contributions (2.5 years x 2 = 5 times).
Example 2: Lieutenant Colonel Ha Thi Hoa, retired in May 2028, has 31 years and 1 month of social insurance contributions. Ms. Hoa has a social insurance contribution period that is 1 year and 1 month higher than the number of years corresponding to the pension rate of 75% (over 30 years), so in addition to her monthly pension, Ms. Hoa is also entitled to a one-time pension upon retirement equal to 3 times the average monthly salary for social insurance contributions (1.5 years x 2 = 3 times).
