Yen Bai - The People's Court of Tram Tau district has just tried the case of "Storing and circulating counterfeit money" committed by two defendants Tran Xuan Duc and Tran Xuan Son, both born in 2003, residing in residential groups No. 1 and No. 2, Tram Tau town, Tram Tau district.
Before that, Tran Xuan Duc went to the Internet cafe in residential group number 2, Tram Tau town to play video games. Here, while using his personal Facebook, Duc saw a Facebook account "Duc Phan" posting an advertisement to sell counterfeit money. Duc texted this person to ask to buy 3.5 million VND of counterfeit money for 500,000 VND of real money and the two parties agreed and agreed on the location to deliver the counterfeit money in the afternoon of the same day.
After receiving 7 fake bills with a face value of 500,000 VND and serial number GQ 10979913, Duc put the money in the trunk of his car and went home. The next day, Duc bragged about buying fake money to his classmate Tran Xuan Son, then the two agreed to go to Ban Mu commune, Tram Tau district to use the fake money to buy peach blossoms to celebrate Tet in exchange for real money. After that, Duc and Son rode a motorbike to Ban Mu commune.
When arriving at a gas station in Mu Thap village, Ban Mu commune, Duc stopped his car and took out a fake 500,000 VND bill to buy gas, but the owner said the bill did not look like real money so he did not take it. At that time, Son had to use his real money to buy gas.
After that, the two continued to the suspension bridge area in Giang La Pan village, Ban Mu commune and went to a grocery store where Duc continued to take a counterfeit bill worth 500,000 VND to buy cigarettes. However, the shop owner discovered that the bill did not look like real money, so she did not sell cigarettes to Duc.
Putting the money in their wallets, seeing that they had not spent the counterfeit money all morning and it was already late, Son and Duc returned to Tram Tau town. However, when Duc and Son arrived at the Ban Mu Commune People's Committee area, they were caught red-handed by the Ban Mu Commune Police and Tram Tau District Police for storing and circulating counterfeit money. The forensic report of the Criminal Techniques Department, Provincial Police concluded that the 7 Vietnamese banknotes with a face value of 500,000 VND, with the same serial number GQ 10979913, were all counterfeit.
With their actions, Tran Xuan Duc and Tran Xuan Son committed the crime of "Storing and circulating counterfeit money" according to the provisions of the Penal Code. The defendants are people with full criminal responsibility, clearly aware that storing and circulating counterfeit money is a violation of the law, causing harm to national monetary security, but due to personal gain, the defendants intentionally committed a crime that endangers society, violates the economic management function, causes disorder and insecurity in the area, and need to be brought to justice to educate awareness of law compliance and general prevention. Apply Clause 1, Article 207; Point h, Point s, Clause 1, Article 51; Article 17, Clause 1, Clause 2, Article 36; Article 58; Article 90; Article 91; Pursuant to Clause 3, Article 98 and Article 100 of the Penal Code, the People's Court of Tram Tau district sentenced defendant Tran Xuan Duc to 1 year and 6 months in prison; defendant Tran Xuan Son to 1 year and 3 months of non-custodial reform for the crime of "Storing and circulating counterfeit money".
The incident shows that, in addition to the active involvement of authorities to prevent and strictly handle illegal acts related to counterfeit money, organizations, units or individuals also need to be more careful in cash transactions to avoid loss of assets. At the same time, people need to actively denounce subjects soliciting the circulation of counterfeit money, not assisting in illegal acts, ensuring social security.
