The People's Committee of Ho Chi Minh City has just issued a Decision on decentralizing construction order management to the Department of Construction, wards, communes and the Management Board of export processing zones and industrial parks in the area.
Specifically, the City People's Committee delegated the responsibility to the Department of Construction to monitor, inspect, detect, prevent and handle projects licensed or appraised by the Department, as well as projects whose feasibility study reports and construction designs were appraised by specialized agencies under the Ministry of Construction .
The Management Boards including: High-tech Park, High-tech Agricultural Park, Export Processing and Industrial Zone of the City are responsible for inspecting and handling all construction activities within the assigned management boundaries, including works within the management scope under the authority of other agencies.

The People's Committees of communes, wards and special zones are assigned to monitor, inspect, prevent and handle illegal construction works, constructions that do not comply with the permit or arise after the works have been accepted and put into use. At the same time, the communes and special zones are assigned to manage the works that they license, appraise and approve according to the City's decentralization.
This Decision takes effect from November 20, 2025, and abolishes previous regulations related to decentralization of construction order management in the former Ho Chi Minh City, the former Binh Duong and the former Ba Ria - Vung Tau , as well as the regulations on coordination of construction order management issued in 2024 of the former Ho Chi Minh City.
Notably, the Decision contains transitional provisions to ensure a smooth transition.
Specifically, before July 1, 2025, the Commune People's Committee will receive and manage projects that were previously under the licensing and appraisal authority of the District People's Committee but have not been or are under construction. The Department of Construction is responsible for handing over all relevant records and documents for the commune and ward levels to continue monitoring and processing.
In case the project is located in two or more communes or wards, the handover will be carried out according to the construction land area ratio of each locality.
The decentralization and delegation of authority in construction order management by the People's Committee of Ho Chi Minh City will avoid overlap, increase initiative and clarify management responsibilities in the construction sector after Ho Chi Minh City merges Binh Duong and Ba Ria - Vung Tau to become a new "super" city.
