Regarding this issue, there is currently a heated discussion, with many people saying that a department head who works in business is a multi-talented person, good for the school, but many others say this is a conflict of interest.

The law does not allow the dean to be the director of a business outside the school.

It should be made clear right away that to appoint a person to the position of faculty leader at a public university, that person must be a civil servant.

The Law on Public Employees, the Law on Anti-Corruption and the Law on Enterprises currently clearly stipulate that public employees are not allowed to hold management positions or be legal representatives of non-state enterprises.

According to legal experts, the above regulation exists because civil servants work under contracts for public service units providing public services. Once they have chosen to become civil servants (under strict management of the State, working for a State unit), lecturers must absolutely comply with the law and be dedicated to their professional work.

In fact, many people are confusing the role of "entrepreneurial lecturer" with the role of a university faculty leader who opens a private company and directly runs a business outside of school.

The law allows civil servants to work outside the working contract period, to sign contracts with agencies, organizations, and units, and to contribute capital to enterprises, so lecturers can still develop their expertise through practical experience.

A lecturer having good business activities and relationships is completely different from a faculty leader directly running his own business outside of school.

Many conflicts of interest when the dean directly runs the business

When a manager is responsible for the business operations of an entire enterprise, there is clearly a risk of conflict of interest, and it is difficult to ensure that the employee fully performs his or her obligations.

If you are not a dean of a major university, how can you be sure that an outside company will invite you to work as a manager in a company? A dean of a public university who opens a company with a business line close to his/her professional work at the school can have an easier time creating prestige for himself/herself and his/her business.

Many people also believe that a dean who holds many positions and does many things is multi-talented and good at everything. But in reality, there are "dean directors who have one foot in two boats", who are accused by lecturers and students of all kinds of things: introducing students to use their company's services, recruiting internally, bringing staff and lecturers to work for the same company...

This clearly causes a conflict of interest, which is completely unprofitable for both the school and the students. How can a dean who owns dozens of companies still have time and passion to work for the department at school?

There are also many opinions that students are often excited to take classes with guest lecturers who are business people.

However, that is completely different from a dean at a university (who is often busy with a lot of faculty work: faculty management, training, scientific research, building and developing training programs, business cooperation...), who must be wholeheartedly devoted to do his role well.

How can "school-based but business-minded" deans manage, teach well and fulfill their responsibilities as deans?

In fact, the Law on HigherEducation 2018 has allowed higher education institutions to establish enterprises and companies to promote scientific research and practical application. If the faculty leader at the school is a multi-talented and well-rounded person, it is entirely possible to develop a project to establish a company under the school to avoid conflicts of interest and affect professional work and tasks.

Around the world , some universities can have dozens, even hundreds of affiliated businesses.
