The inspection report concluded that there were numerous long-standing violations in land allocation, land leasing, and illegal construction on state-managed land, causing billions of dong in losses to the state budget.
According to the inspection report, in 2001, the People's Committee of Kien Giang province (formerly) reclaimed land in the two former districts of Hon Dat and Kien Luong, with a total area of over 33,275 hectares, and handed it over to the Kien Giang Agricultural and Forestry Products Company for management and use according to the plan. Subsequently, the Provincial People's Committee reclaimed and handed over more than 7,952 hectares (of which Hoa Dien commune managed more than 6,881 hectares) to the former Kien Luong district for consideration and allocation to households and individuals for use according to the province's general plan.
In October 2013, Hoa Dien commune requested permission to plant scattered trees along the Dong Hoa dike corridor in Cang hamlet, which was approved by the former Kien Luong district. In 2014, Hoa Dien commune proposed leasing agricultural land to 10 individuals, and the former Kien Luong district issued decisions to lease land to these 10 individuals for the purpose of planting perennial trees, with a total area of 105,692 m² in Cang hamlet. In 2016, due to the construction of the canal and T2-1 road, the former Kien Luong district reclaimed a portion of the land, reducing the remaining leased area to 70,063 m².
The inspection revealed that, among the 10 cases of land lease for perennial crop cultivation, 5 cases involved misuse of land, causing economic losses to the State. These cases involved transferring the fruits of their labor to others for a total of over 1 billion VND, with many individuals building houses and other structures on the land; furthermore, these individuals continued to illegally transfer land for profit, totaling over 4.1 billion VND.
The inspection report concluded that Hoa Dien commune did not conduct a transparent selection process for land lease applicants, selecting 10 individuals who were members of the commune's Party Committee Standing Committee and commune land officials, and "manipulating" the process to have relatives register their names on land lease applications, causing resentment among officials, civil servants, and the people. Furthermore, the former Kien Luong district, when leasing land, did not ensure compliance with legal conditions, grounds, and procedures, leading to 5 cases of land use violations from the time of leasing.
In addition to violations related to the management and use of leased land, the inspection results also highlighted the situation of illegal construction of houses on state-managed land along the T2-1 road. On-site inspections and verifications of 10 land lease cases along the T2-1 road revealed 28 cases of illegal land encroachment and construction.
Following irregularities in the use of public land in Hoa Dien commune, the Provincial Inspectorate has recommended disciplinary action against several individuals, including key leaders and officials of the former Kien Luong district and Hoa Dien commune (formerly), to address their responsibilities.
Specifically, it is requested that the Provincial Party Committee's Organizing Committee review and determine the responsibility of Mr. Le Thanh Huong, Secretary of the Hoa Dien Commune Party Committee, in accordance with the regulations on responsibility during his tenure as Vice Chairman and Chairman of the former Kien Luong District People's Committee (January 2014 - June 2025).
The Provincial Inspectorate proposed that the Department of Internal Affairs advise the Chairman of the Provincial People's Committee to conduct a review and determine the responsibility of Mr. Vo Quang Phuc, Chairman of Hoa Dien Commune People's Committee, for his time as Deputy Chairman of the former Kien Luong District People's Committee (October 2020 - June 2025); and Mr. Pham Van Dang, Deputy Chairman of Kien Luong Commune People's Committee, for his time as Deputy and Head of the Kien Luong District Department of Natural Resources and Environment (March 2017 - June 2025).
On the other hand, the Provincial Inspectorate proposed that the Hoa Dien Commune Party Committee conduct a review and impose disciplinary measures on Mr. Nguyen Huu Tinh, Head of the Party Building Committee, who was responsible during his tenure as Chairman of the Hoa Dien Commune People's Committee (March 2013 - October 2020), and Mr. Nguyen Ngoc Tuan, Chief of the Hoa Dien Commune Party Committee Office, who was responsible during his tenure as Chairman of the Hoa Dien Commune People's Committee (2020 - 2024)...
Furthermore, during the implementation of this inspection conclusion, if violations with sufficient grounds for criminal prosecution are discovered, the case file containing evidence of criminal activity will be transferred to the investigating agency for appropriate handling.
The provincial inspectorate requested that the Hoa Dien Commune People's Committee revoke all leased land from 5 cases of land use violations; review and process cases of illegal construction in accordance with the law; and review the origin and history of land use for related cases to determine appropriate action. The Hoa Dien Commune People's Committee is also required to strictly manage the revoked land area to prevent encroachment and illegal occupation.
